St. Francis Dr., Santa Fe, New Mexico 87505, Telephone (505) 476-3440: Rice Operating Company, Marvin Burrows, Engineering Manager, Telephone (575) 393-9174, 122 West Taylor, Hobbs, New Mexico 88240, has submitted a Stage 1/Stage2 Abatement Plan (AP-48) for the Pipeline Junction L-1, Justis Salt Water Disposal System, located approximately 5.0 miles northeast of Jal in Unit Letter L, Section 1, Township 25 South, Range 37 East, Lea County, New Mexico. Rice Operating Company operates a saltwater disposal pipeline at the site. In the past seven quarters, BTEX parameters have not been detected at or above reporting limits. Chloride impact has been observed in the groundwater at the site and has been delineated. The Stage 1/Stage 2 Abatement Plan proposes that quarterly sampling of all monitor wells will continue until results meet approval of the NMOCD. The information generated will be evaluated and utilized to develop a groundwater remedy, if necessary. The monitor well results will be reported annually until closure. The Stage 1/Stage 2 Abatement Plan also includes a soil Corrective Action Plan. Any interested person may obtain further information from the Oil Conservation Division and may submit written comments to the Director of the Oil Conservation Division at the address given above. CALLING A SPECIAL ELECTION TO BE HELD IN THE CITY OF RIO RANCHO ON MARCH 10, 2009, FOR THE PURPOSE OF VOTING ON THE ISSUANCE OF GENERAL OBLIGATION BONDS IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $25,000,000, DESCRIBING THE PURPOSES TO WHICH THE BOND PROCEEDS WOULD BE PUT; PROVIDING THE FORM OF THE BOND QUESTION; PROVIDING FOR NOTICE OF THE ELECTION; PRESCRIBING OTHER DETAILS IN CONNECTION WITH SUCH ELECTION AND BONDS; AND RATIFYING ACTION PREVIOUSLY TAKEN IN CONNECTION THEREWITH. No judge or clerk of election shall allow a person to vote unless he or she is duly registered as a voter with the Sandoval or Bernalillo County Clerk and unless he or she meets the qualifications of a resident elector or a nonresident municipal elector. Section 9.All persons desiring to vote at the Election (including nonresident municipal electors) must be registered to vote. Any person who is otherwise qualified to vote and who is not currently registered may register at the respective offices of the Sandoval or Bernalillo County Clerks on or before 5:00 p.m. on Tuesday, February 10, 2009, provided, however, that the County Clerks shall accept for filing, certificates of registration that are hand-delivered before 5:00 p.m. on February 10, 2009, or that are postmarked not later than February 10, 2009. Section 10.A "nonresident municipal elector" means any person who on the date of election is a qualified, registered elector of Sandoval County or Bernalillo County but who is a resident of that portion of Sandoval County or Bernalillo County which is outside of the Rio Rancho City limits, and who has paid a property tax on property located within the City of Rio Rancho during the year preceding the election. Not more than sixty nor less than fifteen days before the Election, any nonresident municipal elector desiring to vote on the Bond Election Question shall file with the City Clerk a completed certificate of eligibility in substantially the form provided in Section 3-30-3 NMSA 1978, which shall constitute the nonresident municipal elector's additional registration requirement for voting at the Election on the Bond Election Question. Each nonresident municipal elector must file such certificate of eligibility in addition to registering to vote with the Sandoval or Bernalillo County Clerks. Section 11.For the purpose of this Resolution and solely for the purpose of voting on the Bond Election Question, all territory within the County of Sandoval and the County of Bernalillo is a municipal precinct (hereinafter referred to as the "Municipal District"). All territory in the Municipal District and not within the City's boundaries shall constitute one voting division to be known as the nonresident municipal elector-voting precinct (hereinafter referred to as the "Nonresident Voting District"). The Nonresident Voting District shall include the territory within the boundary of any other municipality within either County. Section 12.The vote shall be canvassed as provided in Section 3-30-7 and Section 3-8-53, NMSA 1978, and the Bond Election Act, Sections 6-15-23 through 6-15-28, NMSA 1978, and the City Clerk shall certify the results of the Election and file the certificate of canvass in the official minute book of the City. Section 13.This Resolution shall be published in the English and Spanish languages at least once a week for four consecutive weeks by four insertions, the first insertion being published between fifty and sixty days before the day of the Election in a newspaper or newspapers which maintain an office in and are of general circulation in the City and which otherwise qualify as legal newspapers in the City. The City Clerk is hereby instructed and authorized to carry out this provision. Section 14.The officers of the City are hereby authorized and directed, for and on behalf of the City, to take all action necessary or appropriate to effectuate the provisions of this Resolution, including, without limiting the generality of the foregoing, the preparation of affidavits, instructions and election supplies, and the publication of notices. Section 15.If any section, paragraph, clause or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this resolution. Section 16. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are hereby repealed to the extent only of such inconsistency. Los Recintos Electorales se consolidaran y los votantes (salvo los votantes en ausencia y los votantes municipales no residentes) votaran en los centros de votacion localizados en el recinto electoral consolidado donde el o ella residen. Boletas en ausencia estaran disponibles para esta eleccion extraordinaria y se pueden obtener si contacta a la Oficialia de la Secretaria de la Municipalidad. La votacion en ausencia personalmente se llevara a cabo en la oficialia de la Secretaria de la Municipalidad, en el Edificio de la Municipalidad, 3200 Civic Center Circle NE, Rio Rancho, a partir del miercoles 11 de febrero 2009, hasta las 5:00 p.m. el viernes 6 de marzo 2009. La votacion se llevara a cabo durante las horas habiles, que son del lunes hasta inclusive el viernes de las 8:00 a.m. -5:00 p.m. Apartado 7.Los votantes calificados emitiran sus votos en los siete (7) centros donde votar, incluso el lugar donde votar en Ausencia, en boleta marksense que se usa en maquinas de tabulacion de escaneo optico. Los votantes calificados de la Municipalidad que no son residentes usaran papeletas impresas para emitir sus votos. Apartado 8. Los votantes calificados de la Municipalidad que son residentes y los votantes de la Municipalidad que no son residentes tendran el derecho de votar respecto a la Cuestion de Bonos. Ninguno de los jueces o secretarios/as de la eleccion permitiran que la persona vote solo que el o ella este debidamente registrado/a como votante con la Secretaria del Condado de Sandoval o en el Condado de Bernalillo y salvo que el o ella reuna las calificaciones de votante residente o votante Municipal que no es residente. Apartado 9. Todas las personas que deseen votar en la Eleccion (incluso votantes municipales no residentes) deberan registrarse para votar. Cualquiera persona que de otra manera califica para votar y que actualmente no esta registrada puede registrarse en las oficialias respectivas de las Secretarias de los Condados de Sandoval o de Bernalillo en o antes de las 5:00 p.m. el martes 10 de febrero 2009, siempre que las Secretarias del Condado acepten para archivar, certificados de registro, que se entreguen personalmente antes de las 5:00 p.m. el 10 de febrero 2009. o que tengan el matasello que no sea posterior al 10 de febrero 2009. Apartado 10.El "votante de la municipalidad no-residente" significa cualquiera persona quien en la fecha de la eleccion es votante calificado, registrado del Condado de Sandoval o del Condado de Bernalillo, sin embargo es residente de esa porcion del Condado de Sandoval o del Condado de Bernalilo que esta afuera de los linderos de la Municipalidad de Rio Rancho y quien ha pagado impuestos sobre la propiedad inmueble que esta localizada dentro de la Ciudad de Rio Rancho durante el ano que antecede la eleccion. No mas de sesenta y no menos de quince dias antes de la Eleccion, cualquier votante de la municipalidad que no es residente que desea votar en la eleccion respecto a la Cuestion de Bonos le presentara a la Secretaria de la Municipalidad un certificado completo que tiene derecho de votar en la forma sustancial segun dispone el Apartado 3-30-3 de Las Leyes de Nuevo Mexico Glosadas de 1978, lo cual constituira el requisito de registro adicional de votante no residente de la Municipalidad para votar en la Eleccion respecto a la Cuestion de Bonos. Cada votante de la Municipalidad que no es residente tiene la obligacion de presentar dicho certificado que tiene derecho de votar ademas de registrarse para votar en las Oficialias de las Secretarias del Condado de Sandoval o del Condado de Bernalillo." Apartado 11.Para los fines de esta Resolucion y unicamente con el proposito de votar respecto a la Cuestion de la Eleccion de Bonos, todo el territorio dentro del Condado de Sandoval y del Condado de Bernalillo es un recinto electoral Municipal ( de aqui en adelante se refiere "Distrito Municipal"). Todo el territorio en el Distrito Municipal y que no esta dentro de los linderos de la Municipalidad y no dentro de los linderos de la Ciudad constituiran recinto electoral donde votar que se conocera como distrito donde votar para votantes de la Municipalidad que no son residentes (de aqui en adelante se referira con la oracion "Distrito Donde Votaran los no Residentes). El Distrito de los No Residentes incluira el territorio dentro del lindero de cualquiera otra Municipalidad dentro de cualquiera de los dos Condados. Apartado 12. El voto sera escudrinado segun dispone el Apartado 3-30-7 y el Apartado 3-8-53 de Las Leyes de Nuevo Mexico Glosadas de 1978 y la Ley de Eleccion de Bonos, Apartados 6-15-23 hasta incluso el Apartado 6-15-28, Leyes de Nuevo Mexico Glosadas de 1978, y la Secretaria de la Municipalidad certificara los resultados de la Eleccion y archivara el certificado del escudrino en libro oficial de actas de la Municipalidad. Apartado 13. Esta Resolucion se publicara en. ingles y en espanol por lo menos una semana durante cuatro semanas consecutivas con cuatro inserciones , la primera insercion se publicara cincuenta y sesenta dias antes del dia de la Eleccion en un periodico o periodicos que tienen oficina en y son de circulacion general en la Ciudad y que de otra manera califican como periodicos legales en la Ciudad. Por la presente la Secretaria de la Municipalidad se le ordena y se le autoriza que realice lo que esta disposicion ordena. Apartado 14.A los funcionarios de la Municipalidad por la presente se le autoriza y se les ordena que por y de parte de la Municipalidad tomen toda las medidas necesarias o apropiadas con el fin de efectuar las disposiciones de esta Resolucion, incluso sin limitar la generalidad de lo antedicho, la preparacion de declaraciones bajo juramento, instrucciones y materiales para la eleccion y la publicacion de notificaciones. Apartado 15.Si cualquier apartado, parrafo, clausula o disposicion de esta Resolucion por cualquier motivo se declara invalida o inejecutable, la invalidez o tal apartado, parrafo clausula o disposicion, no son ejecutables no afectara cualquiera de las disposiciones remanentes de esta resolucion. Apartado 16.Todos los reglamentos internos, ordenes, resoluciones y ordenanzas o partes de las mismas que no son consistentes con la presente, por la presente se derogan hasta solo donde existe tal inconsistencia. Este derogador no se entendera que revive cualquier reglamento interno, orden, resolucion u ordenanza o partes de las mismas/ los mismos, hasta ahora revocados. ADOPTADO ESTE DIA 14 DE ENERO 2009.
