Notice is hereby given that on January 13, 2009, co-applicants Deborah M. Pierce Gowen and Greg Gowen, PO Box 3198, Corrales NM, 87048, and Rick & Mitzi Hobson, PO Box 1205, Corrales NM, 87048, filed Application No. SD-07979 into RG-12129 with the STATE ENGINEER for Permit to Change Point of Diversion and Place and/or Purpose of Use From Surface to Ground Water within the Rio Grande Basin of the State of New Mexico. The applicants propose to discontinue the farm delivery requirement of 14.89 acre-feet of surface water per annum, inclusive of a consumptive irrigation requirement amount of 10.43 acre-feet per annum, for the irrigation of 4.9645 acres of land owned by Deborah M. Pierce Gowen and Greg Gowen, described as Tracts 16A1A and 16C on MRGCD Map 15, within Section 23, Township 12 North, Range 3 East, NMPM, from the Corrales Main Canal, with a point of diversion on the Rio Grande at the Angostura Diversion Works located at a point where X=425,990.4 feet and Y=1,593,567 feet, New Mexico State Plane Coordinate System (NMSPCS), Central Zone, NAD 1927. The move-from lands are generally located on the northwest corner of the intersection of Corrales Road and Camino Todos Los Santos, in the Village of Corrales, Sandoval County, New Mexico. The applicants further propose to transfer the water rights described above to an existing well owned by, and on land (Lot 78A1, MRGCD Map 18) owned by, Rick and Mitzi Hobson, and identified by OSE File No. RG-12129-POD2 (permitted for domestic and livestock use). Well RG-12129-POD2 is located at a point where X=1,527,031 feet and Y=1,539,281 feet, NMSPCS, Central Zone, NAD 1983, in the Town of Alameda Grant. The well is 155 feet below land surface, and it is fitted with 6 5/8-inch casing. The purpose of this application is to transfer pre-1907 surface water rights into groundwater well RG-12129-POD2 for the purpose of providing a source of water for applicant's existing and future vineyard operations on approximately 6.0 acres within the total of 7.63 acres consisting of the east half of Tract 112A1A1A, Tract 110A1A, and Lots 78A1 and 83 on MRGCD Map 18, within Vista Corrales Subdivision in the Village of Corrales, Sandoval County, New Mexico. Rick and Mitzi Hobson and William and Susan White are the owners of the vineyard lands. By this application, applicants Hobson request the right to divert up to a maximum of 11.59 acre-feet per annum for the purpose of drip-irrigating approximately 6.0 acres of vineyard described above. Any person or other entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) Be detrimental to the objector's water right; or (2) Be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that the objector shows how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible, signed, and include the complete mailing address of the objector. An objection or protest must be filed with the state engineer not later than 10 calendar days after the date of the last publication of this notice. An objection or protest may be mailed to the Office of the State Engineer, 121 Tijeras NE, Suite 2000, Albuquerque, NM 87102, or faxed to (505) 764-3892 provided the original is hand-delivered or postmarked within 24 hours after transmission of the fax.
