To the extent that the following annual amounts exceed the amounts of WTG rent paid by Lessee during the applicable year Lessee shall also pay to Lessor 3.0 % of the gross revenues from energy sales net of wheeling from all WTGs installed on the state trust land actually received by Lessee in each calendar year during years #1 - #20 of the lease term, and 5.0 % of the gross revenues from energy sales net of wheeling from all WTGs installed on the state trust land actually received by Lessee in each calendar year during years #21 - #35 of the lease term. It is currently estimated that a minimum of five (5) Wind Turbine Generating (WTG) Units could be constructed on the state trust land leased under BL-1915. The lease contains rent adjustments and terms regarding liens, building/transmission line installation fees, ground disturbance fees for both ancillary buildings and WTGs, rent for built-up floor space, assignment and subletting, relinquishment, default, insurance, indemnification, and the like, and is subject to all pertinent State statutes and rules. D)Requirements and qualifications of bidders. As a condition precedent to bidding at the auction, a bidder must demonstrate to the satisfaction of the Commissioner of Public Lands, must have in its possession and must deposit with Lessor, evidence: 1)that they have, or have the right to assignment of, or can be reasonably expected to obtain, an interconnection agreement sufficient to enable interconnection and delivery of energy from the maximum number of Wind Turbine Generating Units that can be reasonably constructed on the Property; 2)that they have, or have the right to assignment of, or can be reasonably expected to obtain an executed power purchase agreement that provides for the immediate purchase, from the bidder, by a regulated, licensed to operate, and operating utility, the full electrical output of the maximum number of Wind Turbine Generating Units that can be reasonably constructed on the Property; 3)that they have, or can reasonably be expected to obtain a binding agreement for the procurement and delivery of the Wind Turbine Generating Units to be constructed on the Property; 4)that they have, or can reasonably be expected to obtain recorded real property interests from the owners of neighboring and nearby lands sufficient to provide both legal and practical access to the Property from a public road; 5)that the bidder shall have prepared and submitted to Lessor a completed application to lease the Property as required by 19.2.9.9 of the Rules, which application is satisfactory to Lessor; 6)that, by letter of intent or a similar commitment from a bank acceptable to the Commissioner, they can obtain a letter of credit from a bank acceptable to the Commissioner, renewable for the term of the lease, in the amount of $250,000.00 to secure payment of rent, that can be adjusted upward to reflect rental adjustments every five years; 7)that they or their affiliates have aggregated balance sheet assets in excess of $1,000,000,000: 8)that the officers, principals, and affiliates of the bidder collectively have at least one hundred twenty five (125) years experience in the utility-scale wind power generation industry; and, that any transferee have experience sufficient to satisfy the Commissioner that they could be reasonably capable of constructing and operating the project; 9)that they have the ability to comply fully with all terms of the Lease; Any and all prospective bidders will have one week after the final advertisement date to provide such evidence as appears above to the Commissioner for his review. In order to complete the requirements and qualify to bid, and, prior to commencement of the auction, each prospective bidder must deposit $1,642,833.13 with the Commissioner of Public Lands in the form of a certified or cashier's check or bank money order, made payable to the Commissioner of Public Lands.
