NOTICE is hereby given that on June 26, 2009, the City of Rio Rancho ("City"), 3200 Civic Center Circle, N.E., Rio Rancho, NM 87144, and Co-Applicants Toby G. Lafferty, 4010 South Olympic Way, Salt Lake City, Utah 84124 and Leo Jay Korte, 2817 Viola SW, Albuquerque, New Mexico 87105, filed Application No. SD-07077-A into RG-6745 et al. with the STATE ENGINEER for Permit to Change Point of Diversion, Place and Purpose of Use from Surface to Ground Water in the Rio Grande Underground Water Basin. The applicants propose to discontinue the diversion of 17.526 acre-feet of water per annum, inclusive of a consumptive irrigation requirement of 12.2682 acre-feet per annum (afa), from the Pajarito Lateral with a point of diversion on the Rio Grande at the Angostura Diversion Dam of the MRGCD (SP-1690-2), located at a point where X=425,990.4 feet and Y=1,593,567 feet, NMCS, Central Zone, NAD 1927, Angostura Grant, also located in the SW1/4 SE1/4 SE1/4 of Section 3, Township 13 North, Range 4 East, NMPM, Sandoval County, used for the irrigation of 5.842 acres of land, owned by Leo Jay Korte, described as Tract 121-A (2.0 acres), Tract 121-B (1.842 acres) and Tract 121-D (2.0 acres), MRGCD Map 46, within Section 1, Township 9 North, Range 2 East, NMPM. The move-from land is generally located approximately 800 feet south of Blake Rd. bound by the Pajarito Lateral, Bernalillo County, New Mexico. The applicants further propose to transfer the above-described 12.2682 afa of consumptive irrigation requirement water rights to the City of Rio Rancho's wells permitted under RG-6745 et al., consisting of 35 existing and proposed system production wells, all located on land owned by the City and within the City's metropolitan area, Sandoval County, for municipal use within the service area (owned by numerous owners) of the City municipal water system. The diversion of water under permit RG-6745 et al. shall not exceed 24,020.16 acre-feet per annum for domestic, commercial, industrial, housing subdivision, and related purposes within the service area of the Rio Rancho Municipal Water System. No increase in diversion is contemplated by the transfer of water rights under this application to the City municipal water system. This application is made for the purpose of complying with Permit No. RG-6745 et al. which requires the City of Rio Rancho to offset the impacts of groundwater pumping on the surface flows of the Rio Grande and its tributaries. Any person or other entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) Be detrimental to the objector's water right; or (2) Be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that the objector shows how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible, signed, and include the complete mailing address of the objector. An objection or protest must be filed with the state engineer not later than 10 calendar days after the date of the last publication of this notice. An objection or protest may be mailed to the Office of the State Engineer, 121 Tijeras NE, Suite 2000, Albuquerque, NM 87102-3465, or faxed to 505-764-3892 provided the original is hand-delivered or postmarked within 24 hours after transmission of the fax.
