NOTICE is hereby given that on December 30, 2020, Michele Goodson (water right owner), 133 Tyrone NW, Albuquerque New Mexico, 87107 and Blattner Energy (water right lessee), c/o Mitchel Janousek, 392 Co. Rd 50, Avon Minnesota, 56310, filed with the STATE ENGINEER Application No. FS-940 (T) for permit under Water-Use Leasing Act (NMSA 1978, Sections 72-6-1 thru -7) to temporarily change the place and purpose of use of 25.0 acre feet per annum of shallow groundwater within the Fort Sumner Basin of the State of New Mexico. Torrance County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Albuquerque Journal. Application Number FS-940 (T) is for a permit to temporarily change an existing Water Right by temporarily ceasing the diversion of 25.0 acre-feet per annum of shallow groundwater from the following point of diversion: Move-From Well FS-940 Subdivision NEl/4SE1/4SEl/4 Section 17 Township 05N Range 14E N.M.P.M., and ceasing the irrigation of 10.0 acres of farm land located in a portion of the S1/2SE1/4SEl/4 of Section 17, Township 05 North, Range 14 East, N.M.P.M. The applicant proposes to commence diversion of 14.4 acre-feet per annum (consumptive use) from FS-940 for the use in the construction of wind farms in eastern Torrance County. More specifically, the water will be used for the proper compaction of soil foundations and the mixing of concrete. The well and move-from place of use are located immediately west of the town of Encino, New Mexico, just north of Highway 60/285. The proposed move to place of use is in the eastern portion of Torrance County New Mexico. This application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7. Preliminary approval was granted.
