BEFORE THE NEW MEXICO PUBLIC REGULATION COMMISSION Docket No. 10-00083-TR-M IN THE MATTER OF THE APPLICATION OF MOVING SOLUTIONS, INC. FOR A CERTIFICATE TO PROVIDE HOUSEHOLD GOODS CARRIER SERVICE AND FOR TEMPORARY AUTHORITY ORDER GRANTING TEMPORARY AUTHORITY THIS MATTER comes before the New Mexico Public Regulation Commission ("Commission") upon the Application of Moving Solutions, Inc. For A Certificate to Provide Household Goods Carrier Service and Temporary Authority ("Application"). Being fully informed in the premises, THE COMMISSION FINDS AND CONCLUDES: 1. On March 29, 2010, Moving Solutions, Inc ("Applicant") filed an Application for a Certificate and Temporary Authority to transport household goods statewide and return, with equipment to be stationed at 3811 Prince St. SE, Albuquerque, NM 87105. 2. The Commission may, in its discretion, pursuant to 18.3.2.29(A) NMAC, grant temporary authority to a person applying for a certificate for a period not to exceed 90 days if it finds that the Applicant meets the requirements of NMSA 1978 65-2A-11 by showing that there is an urgent and immediate need for such service, that the applicant has a complete application for a certificate pursuant to 18.3.2.15 NMAC, and that, for common motor carriers, a tariff has been filed. 3. Rule 18.3.2.29(B) NMAC requires that when an Applicant files its request for Temporary Authority in conjunction with an Application for Permanent Authority, as is the case here, the Commission shall not grant temporary authority unless: a) the Director has certified that the Application is complete within the meaning of 18.3.2.15 NMAC; b) Applicant has shown an urgent and immediate need for the proposed service by filing affidavits from one or more persons having need of the service, and stating that either: 1) no other motor carrier is providing the transportation service in the territory the applicant seeks to serve, or 2) another motor carrier is providing such transportation service, but that such transportation service is inadequate in rates, routes or service; and c) the filing fee has been paid in accordance with NMSA 65-2A-36. 4. The Applicant's Application contains evidence of urgent and immediate need for the transportation service in the form of signed and/or signed and notarized letters from Walters Government Consulting, Mills Van Lines, Inc., Business Environments, New Mexico Gas Company and All America Relocation, Inc., stating that the Applicant has provided excellent service in moving office equipment and that Applicant's services are much needed on intrastate shipments throughout the state. Thus, in accordance with NMSA 1978 65-2A-11(B), the Applicant has endeavored to provide satisfactory verified proof of urgent and immediate need for the proposed transportation services. Purusant to 18.3.1.10(A) NMAC, the Commission may waive that portion of 18.3.2.29 NMAC which directs the applicant to show urgent and immediate need by affidavit and may deem the letters to be satisfactory verified proof of urgent and immediate need as required by the statute. 5.The Director of the Transportation Division ("Director") has certified that the Application for Temporary Authority is complete pursuant to the requirements of 18.3.2.15 NMAC and that the Applicant has met the requirements for temporary authority under 18.3.2.29(A) and (B) NMAC (i.e., to satisfy the requirements of NMSA 1978 65-2A-11 and 18.3.2.15). 6.The Applicant has submitted the required $100 fee for temporary authority in compliance with NMSA 65-2A-36. 7.The Director has recommended that Temporary Authority should be approved. 8.The requirements of 18.3.2.15 NMAC (certificate requirements for motor carriers), NMSA 1978 65-2A-11 and 18.3.2.29 NMAC (statutory and regulatory requirements for temporary authority) and NMSA 65-2A-36 (fee requirements) have been met or waived. 9.The Applicant's request for Temporary Authority should be granted. IT IS THEREFORE ORDERED: A.The Applicant is granted a 90-day Temporary Authority to transport household goods statewide and return, with equipment to be stationed at 3811 Prince St. SE, Albuquerque, NM 87105. B.This Temporary Authority is granted subject to all applicable laws, rules and further orders of the Commission, including but not limited to the New Mexico Motor Carriers Act NMSA 1978 65-2A-1 through 65-2A-40 and the Commission's Motor Transportation Rules, except as herein waived.
