NOTICE is hereby given that on February 11 and April 2, 2009, the City of Rio Rancho, c/o Lisa Vornholt, 3200 Civic Center Circle NE, Rio Rancho, NM 87144, along with Excel Builders and Developers, LLC, 7 Mile High Court, Belen, NM, 87002, filed as co-applicants, Application No. SD-08355 into RG-6745 et al., with the STATE ENGINEER for Permit to Change Point of Diversion, Place and Purpose of Use from Surface to Ground Water within the Rio Grande Underground Water Basin. The applicants propose to discontinue the diversion of 8.1303 acre-feet of surface water per annum, inclusive of a consumptive irrigation requirement of 5.6912 acre-feet per annum (afa), from the La Cercas of the Peralta Main Canal, with a point of diversion on the Rio Grande at the Isleta Diversion Works of the MRGCD (SP-1690-3), located at a point where X=369,686.4 feet and Y=1,421,189 feet, NMCS, Central Zone, NAD 1927, Isleta Pueblo Grant, also located in the NE1/4 NE1/4 SW1/4 of Section 24, Township 8 North, Range 2 East, NMPM, for the irrigation of 2.7101 acres of land, owned by Excel Builders and Developers, LLC, described as Tract A of Land Division Plat, Land of Michael Postlethwait, comprising Tract 38-B-3-A-1-A-2, all on MRGCD Map 76. The above described tract is generally located on the southeast corner of Highway 47 and Omar Road, within Los Lunas, Valencia County, New Mexico. The applicants further propose to transfer the above-described 5.6912 afa of consumptive irrigation requirement to the City's permitted wells under RG-6745 et al., consisting of 35 existing and proposed system production wells, all located within the city metropolitan area in Sandoval County, for municipal use within the service area of the Rio Rancho municipal water system. Diversion of water under City of Rio Rancho's permit RG-6745 et al. shall not exceed 24,020.16 acre-feet per annum for domestic, commercial, industrial, housing subdivision, and related purposes within the service area of the Rio Rancho Municipal Water System. No increase in diversion is contemplated by the transfer of water rights under this application. This application is made for the purpose of complying with Permit No. RG-6745 et al., which requires the City of Rio Rancho to offset the impacts of groundwater pumping on surface flows of the Rio Grande. Any person or entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) be detrimental to the objector's water right; or (2) be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that they show how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible and signed, and include the mailing address of the objector. An objection or protest must be filed with the State Engineer no later than 10 calendar days after the date of the last publication of this notice.
