NOTICE OF INTENTION TO APPROPRIATE NONPOTABLE GROUND WATER FROM AN AQUIFER WHOSE TOP IS 2,500 FT OR MORE BELOW GROUND LEVEL Diamond Tail Limited, a Texas Limited Partnership, c/o Leroy Bolt, CPA, Condley & Company, P.O. Box 2079, Abilene, TX 79604-2079 hereby gives notice pursuant to NMSA 1978, 72-12-25 through 72-12-28 of its intention to appropriate nonpotable ground water from an aquifer whose top is more than 2,500 feet below ground level (bgl). The new wells will be located within a 1,000 foot radius of the following positions. Well #1 is located at East (X) = 376,555 meters and North (Y) = 3,909,030 meters UTM Zone 13 (NAD 27) on land owned by Diamond Tail Limited. Well #2 is located at that point where East (X) = 376,660 meters and North (Y) = 3,910,500 meters UTM Zone 13 (NAD 27) on land owned by Diamond Tail Limited. All well locations are in the Town of Tejon grant in Sandoval County, New Mexico. The approximate depth of the wells will be less than 5,000 ft bgl. Diamond Tail Limited proposes to hire a well driller licensed in the State of New Mexico and to cement 13-3/8-inch surface casing to a depth of greater than 2,500 ft bgl. The wells will be completed in accordance with NMOSE rules and regulations for artesian well completions. The NMOSE will be notified before cementation of said surface casing to witness satisfactory installation per the above stated regulations. The estimated amount of water to be diverted and used from each well is 50 acre-feet per annum. The purposes of use include domestic, livestock, irrigation, municipal, recreational, industrial, commercial, subdivision, and related uses. The water pumped will be treated as necessary and then applied to the uses specified. The place of use shall be within the boundaries of the properties of Diamond Tail Limited, Placitas Heights, LLC, and Diamond Tail Estates I, LLC, in Sandoval County, New Mexico, as presently constituted and as may be enlarged from time to time.
