NOTICE OF AIR QUALITY PERMIT APPLICATION The Sandoval County Landfill announces its intent to apply to the New Mexico Environment Department for an air quality permit for the addition of a Rock Crusher/Waste Shredder plant to its landfilling operations. The expected date of application submittal to the Air Quality Bureau is July 10, 2009. This notice is a requirement according to New Mexico air quality regulations. The exact location for the Sandoval County Landfill facility is 2700 Iris Road NE, Rio Rancho, NM 87124. The facility is located immediately north of the intersection of Iris and Idalia Roads, approximately 1.5-miles northwest of the intersection of NM 528 and Iris Rd. in Rio Rancho. The proposed modification/ construction consists of the following: The Sandoval County Landfill is proposing the addition of a Crusher/Waste Shredder plant to Landfill operations to be used for the recycling of asphalt surfacing to be used as a recycled roadbed material at the landfill and for other County road projects. The Crusher/Waste Shredder plant will also be used to shred green waste for use in the facility's composting operation, and for shredding municipal solid waste to reduce waste volume prior to its disposal in the landfill. The addition of this new plant will not change the volume of waste accepted at the facility, and will facilitate recycling efforts and effectively reduce the amount of non-putrescible materials disposed of in the landfill. NOTICE is hereby given that on July 17, 2009, Jemez Springs Domestic Water Association (DWA), c/o Emmett H. Cart, President, P.O. Box 123, Jemez Springs, NM 87025, filed Application No. RG-74166 with the STATE ENGINEER for Permit to Increase the Diversion of Underground Water within the Rio Grande Ground Water Basin. Under permit SD-02541-B and SD-02541-C into RG-74166, approved February 4, 2009, Jemez Springs DWA is permitted to divert the consumptive use amount of 22.91 acre-feet of water per annum from well RG-74166, to be located within 373 feet of a point where X=1,517,413.98 feet and Y=1,754,171.48 feet, NMCS, Central Zone, NAD 1983, Canon de San Diego Grant, to be drilled 250 feet deep with 8-inch casing, for domestic, irrigation, municipal, industrial and commercial purposes within the service area of Jemez Springs DWA. General Description: undrilled well RG-74166, will be located approximately 2,000 feet south of Hummingbird Music Camp on the west side of NM State Hwy 4, and north of the Village of Jemez Springs, Jemez Mountains, Sandoval County. The applicant proposes to increase its diversion of water from said well RG-74166 for the purposes above in the same place of use, from 22.91 acre feet per annum (afa) to a maximum of 45.82 afa through a return flow credit based on the metered output from the Village of Jemez Springs' wastewater treatment plant. The maximum return flow requested is 50% of Jemez Springs DWA's consumptive use amount of 22.91 afa. The applicant submitted with the application a report titled "Jemez Springs Return Flow Report", dated June 2009, by Souder, Miller & Associates, demonstrating that more than enough water will be returned to the Jemez River through the wastewater treatment plant to offset the proposed increase in diversions. Since 2003, the plant has returned to the Jemez River an average of 64% of the water that the Jemez Springs DWA delivered to its customers. The maximum return flow credit requested, however, is significantly less than that, topping out at 50%. Further, only the metered return flow from the wastewater plant is proposed as the basis of the return flow credit, and the Jemez Springs DWA is not seeking any return flow based on returns from septic tanks. The consumptive use amount will not increase. The parties protesting Jemez Springs' underlying well application, the Pueblos of Zia and Santa Ana, and the Water Rights Division of the OSE agreed to this application for a return flow credit under the conditions stated here. The previous application to transfer surface water rights to the Jemez Springs DWA's well was OSE File No. SD-02541-B and SD-02541-C into RG-74166, as noted above. In that proceeding, following an agreement among the parties, Hearing Examiner, Andrew B. Core, issued an Order Dismissing Protestants, Remanding Application and Dismissing Hearing on December 11, 2008, and Water Rights Division issued the permit on February 4, 2009. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (legible, signed, and include the writer's complete name and mailing address). LEGAL NOTICE and Preliminary Determination for an Air Quality Permit for J D Heiskell and Company J D Heiskell and Company, 117 E. Commercial St., Portales, NM 88130 has submitted an air quality permit application to the New Mexico Environment Department (NMED) for an air quality permit to construct the J D Heiskell and Company - Portales Plant. The application file has been assigned Permit No. 4053 and TEMPO Agency Interest ID No. 28329. The exact location of the facility is at latitude 34 deg, 11 min, 17 sec and longitude -103 deg, 20 min, 15 sec. The exact location of this facility is 117 E. Commercial St., Portales, New Mexico in Roosevelt County. This is facility is an animal feed mill, originally constructed decades ago but had never obtained an air quality permit. Once issued, the New Source Review permit will bring the facility into compliance with the requirements of the Federal Clean Air Act. Total air pollutant emissions to the atmosphere are estimated to be approximately 3.8 tons per year of oxides of nitrogen reported as nitrogen dioxide (NOx); 3.2 tons per year of carbon monoxide (CO); 0.2 tons per year of volatile organic compounds (VOC); 0.02 tons per year of sulfur dioxide (SO2); 5.6 tons per year of particulate matter less than 2.5 microns (PM2.5); 11.3 tons per year of particulate matter less than 10 microns (PM10); 21.5 tons per year of total suspended particulates (TSP); and negligible quantities of total hazardous air pollutants (Total HAP). These emission estimates could change slightly during the course of the Department's review of the application. The NMED has conducted a preliminary review of the information submitted with the permit application. The preliminary review and dispersion modeling analysis indicates that the facility's air emissions will meet the ambient air quality standards for NOx, CO, SO2, PM2.5, PM10, and TSP. A full review will evaluate the estimated emission rates and the air quality dispersion modeling analysis to determine compliance with ambient air standards. Based on the applicant's analysis, a preliminary determination is that this facility will comply with the requirements of Title 20, New Mexico Administrative Code (NMAC), Chapter 2, Parts 3, 7, 61, 72, 73, 75, and the New Mexico Air Quality Control Act. Therefore, the preliminary intent of NMED is to issue the air quality permit on or before October 28, 2009. This source is a minor source according to 20.2.74 NMAC, PSD. To ensure compliance with state and federal air regulations, the permit is expected to include conditions that limit the emissions, hours of operation, and production rate, and conditions that will require record keeping and reporting to the Department. The permit application is currently available for review at the Air Quality Bureau Office, 1301 Siler Road, Building B, Santa Fe, New Mexico. The Department contact in Santa Fe is Coleman Smith. A copy of the permit application was mailed to the NMED Clovis Office, located at 100 Manana Blvd., Unit 3, Clovis, NM 88101 for public review. All interested persons have thirty (30) days from the date this notice is published, to notify the Department in writing of their interest in the permit application. The written comments should refer to the company name, site name and Permit No. (or send a copy of this notice along with your comments). The written comments shall state the nature of the issues raised and how it relates to the requirements of applicable state and federal air quality regulations and the Clean Air Act.
