NEW MEXICO ENVIRONMENTAL IMPROVEMENT BOARD NOTICE OF RULEMAKING HEARING The New Mexico Environmental Improvement Board ("Board") will hold a public hearing on July 7, 2009 at 8:00 a.m. in Room 317 at the State Capital in Santa Fe, New Mexico. The purpose of the hearing is to consider the matter of EIB 09-04 (R), proposed revisions to Air Quality Control Regulations 20.2.2 New Mexico Administrative Code (NMAC) (Definitions); 20.2.74 NMAC (Permits-Prevention of Significant Deterioration) and 20.2.79 NMAC (Permits- Nonattainment Areas). The proponent of this regulatory adoption and revision is the New Mexico Environment Department ("NMED"). The purpose of the public hearing is to consider and take possible action on a petition from NMED regarding proposed revisions to 20.2.2 NMAC - Definitions; 20.2.74 - Permits - Prevention of Significant Deterioration; and 20.2.79 - Permits - Nonattainment Areas to comply with Implementation Rules adopted by the U.S. Environmental Protection Agency (EPA) for the 8-hour ozone and particulate matter 2.5 microns in size and less (PM2.5) National Ambient Air Quality Standards (NAAQS). Under Section 110(A)(2) of the Clean Air Act, states are required to update state implementation plans upon the promulgation of a new or revised NAAQS. The NMED will host an informational open house on the proposed revisions to 20.2.2 , 20.2.74, and 20.2.79 NMAC at the NMED Air Quality Bureau Office, 1301 Siler Rd, Building B, Santa Fe, New Mexico 87507, from 2:00p.m.-6:00p.m. on May 21, 2009. The proposed revised regulations may be reviewed during regular business hours at the NMED Air Quality Bureau office, 1301 Siler Road, Building B, Santa Fe, New Mexico. El proposito de la audiencia publica es considerar y tomar posible accion sobre una peticion del NMED con relacion a las revisiones propuestas al 20.2.2 NMAC - Definiciones; 20.2.74 - Permisos - Prevencion de deterioro significativo; y 20.2.79 - Permisos - Areas de no-obtencion para cumplir con la Normas de Implementacion que adopto la Agencia de Proteccion Ambiental de los Estados Unidos (EPA, por sus siglas en ingles) para el ozono de 8 horas y materia particulada de 2.5 micrones de tamano y menos (PM2.5) Estandares Nacionales de la Calidad del Aire Ambiental (NAAQS, por sus siglas en ingles). Bajo la Seccion 110(A)(2) de la Ley de Aire Limpio los estados tienen la obligacion de actualizar sus planes de implementacion estatal cuando se promulguen NAAQS nuevos o revisados. El NMED celebrara una actividad informativa abierta al publico sobre las revisiones propuestas al NMAC 20.2.2, 20.2.74 y 20.2.79 en la Oficina de Control de Calidad del Aire del NMED, 1301 Siler Rd, Building B, Santa Fe, New Mexico 87507 de 2:00 p.m. a 6:00 p.m. el 21 de mayo de 2009. Las regulaciones revisadas propuestas estan disponibles para revision durante horas laborales regulares en la oficina del Control de Calidad del Aire del NMED, 1301 Siler Road, Building B, Santa Fe, New Mexico. Las personas que deseen presentar testimonio tecnico tienen que presentar a la Junta notificacion escrita de su intencion de hacerlo.
