NOTICE OF SALE Notice is hereby given that the undersigned Special Master will, on October 6, 2009, at 9:00 a.m., at the main entrance of the Bernalillo County Courthouse, 400 Lomas Blvd. NW, Albuquerque, New Mexico, sell and convey to the highest bidder for cash at the time of the sale all the right, title and interest of the above-named Defendant in and to the following described real estate located in the above-named County and State: Lot numbered Fifteen-P1 (15-P1), in Block numbered Two (2), Plat of Crystal Ridge Subdivision Unit 2, within the Town of Alameda Grant, projected Sections 6 and 7, Township 11 North, Range 3 East, N.M.P.M., City of Albuquerque, New Mexico, as the same is shown and designated on the Plat of said Subdivision, filed in the office of the County Clerk of Bernalillo County, New Mexico, on June 1, 1998, in Plat Book 98C, folio 154. The address of the real estate is 4419 Loren Avenue NW, Albuquerque, New Mexico. The sale will be made pursuant to the Decree of Foreclosure entered on August 3, 2009, in the above-entitled and numbered cause, which was a suit to foreclose a note and mortgage held by Plaintiff and where Plaintiff was granted judgment and has a lien against the above-described real estate in the sum of $92,019.32 (including interest to the date of sale), plus additional costs and attorney's fees necessary to protect the real estate, together with costs of sale including a reasonable Special Master's fee. Plaintiff has the right to submit any respective bids verbally or in writing. Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash. At the date and time of the sale, the Special Master is empowered to postpone the time and date of the sale if he deems such postponement advisable by appearing at the time, date and place advertised and announcing to all present that the sale is postponed to a new time, date and place. The Special Master shall not be required to publish any notice of the new time, date and place of the postponed sale. Notice is further given that the real property and improvements will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the county assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any. Notice is further given that this sale may be subject to a bankruptcy filing, a pay off, a reinstatement or any other condition that would cause the cancellation of this sale. Further, if any of these conditions exist, this sale will be null and void. The successful bidder's funds shall be returned, and the Special Master and Plaintiff shall not be liable to the successful bidder for any damages.
