Notice is hereby given that on June 26, 2009, co-applicants Toby Pino and Lydia Pino, 2272 Calle de Ortiz, Los Lunas NM 87031; and the City of Rio Rancho ("City"), 3200 Civic Center Circle NE, Rio Rancho, New Mexico 87144; filed Application No. SD-08446 into RG-6745 et al. with the STATE ENGINEER for Permit to Change Point of Diversion, Place, and Purpose of Use from Surface to Ground Water in the Rio Grande Underground Water Basin of the State of New Mexico. The applicants propose to discontinue the farm delivery requirement of 5.301 acre-feet of surface water per annum, inclusive of a consumptive irrigation requirement use of 3.7107 acre-feet per annum (afa), from the San Francisco Acequia via the Rio Grande, with a point of diversion located in the NE1/4 NE1/4 SW1/4 of Section 24, Township 8 North, Range 2 East, NMPM, at the Isleta Diversion Works (SP-1690-3) of the MRGCD, located at a point where X-369,686.4 feet and Y=1,421,189 feet, NMCS, Central Zone, NAD 1927, Isleta Pueblo Grant for the irrigation of 1.767 acres of land owned by Toby Pino and Lydia Pino, described as Parcel G (Lands of Ramona Lopez, Re-plat of Tract 17) on MRGCD Map 136, located in Township 2 North, Range 1 East, Section 16, NMPM. The move-from land is generally located in the "San Francisco" area south of Bernardo, NM, from whence Mile Post 951 on the RR tracks bears NW, 0.30 mile. Ramon Lopez Road is 300 feet north of the north property line with the south property line adjoining the San Francisco Acequia, Socorro County. Applicants further propose to transfer the described total of 3.7107 afa of consumptive irrigation requirement water rights to the City's permitted wells under RG-6745 et al., consisting of 35 existing and proposed system production wells, all located within the City metropolitan area within Sandoval County, for municipal use within the service area of the Rio Rancho municipal water system. Diversion of water under the City's permit RG-6745 et al. shall not exceed 24,020.16 afa for domestic, commercial, industrial, housing subdivision, and related purposes within the service area of the City Municipal Water System. No increase in diversion is contemplated by the transfer of water rights under this application. This application is made for the purpose of complying with Permit RG-6745 et al., which requires the City to offset the impacts of groundwater pumping on surface flows of the Rio Grande and its tributaries. Any person or entity shall have standing to file an objection or protest if they consider that the granting of the application will be: (1) detrimental to their water right; or (2) contrary to the conservation of water within the state or detrimental to the public welfare, provided the persons or entities show how they will be specifically and substantially affected by the granting of the application. A valid protest or objection shall set forth the grounds for asserting standing, be signed, and include the complete mailing address of the protestant. A protest or objection must be filed with the State Engineer not later than 10 calendar days after the date of the last publication of this notice. A protest or objection may be mailed to the Office of the State Engineer, 121 Tijeras NE Suite 2000, Albuquerque, NM 87102, or faxed to (505) 764-3892, provided the original is hand-delivered or postmarked within 24 hours after transmission of the fax.
