PUBLIC NOTICE Air Quality Authority-to-Construct Permit for New Mexico VA Health Care System The US Department of Veterans Affairs (Veterans Affairs Department) has submitted an application, to modify existing Authority-to-Construct air quality Permit No. 1417, to the Air Quality Division (Division) of the City of Albuquerque Environmental Health Department. The Veterans Affairs Department is requesting the replacement of an existing ethylene oxide (ETO) sterilizing unit with four (4) ETO sterilizing units and the replacement of three (3) existing diesel-fired emergency generators with three newer ones of comparable horsepower for the facility located at the New Mexico VA Health Care System, 1501 San Pedro Drive SE in Albuquerque, New Mexico. They are also requesting the addition of a research and development laboratory and two (2) natural gas-fired clothes dryers to the existing permit. The owner of this facility is the Veterans Affairs Department, 1501 San Pedro Drive SE, Albuquerque, New Mexico 87108. This application file has been assigned Permit No. 1417-M1. The New Mexico VA Health Care System facility is a hospital specializing in care for New Mexico veterans. The Notice of Intent further states that this notice relates to the filer's intent to recover, develop, and beneficially use water from aquifers, the top(s) of which are below the ground surface at a depth of at least 2,500 feet and which water is in excess of 1,000 parts per million dissolved solids. Any person may bring an action in the district court of the county in which any such well is situated for damages or for injunctive relief with respect to any claimed impairment of existing water rights due to an appropriation of nonpotable water under 72-12-25 to 72-12-28 NMSA 1978.
