The above-captioned action was to foreclose a mortgage wherein Plaintiff was adjudicated to have a prior and valid lien against the Subject Real Property for which it received a Judgment in the principal amount of $1,205,544.00 as of November 15, 2009, plus accrued interest in the amount of $27,865.701 as of November 15, 2009, late fees in the amount of $401.26, legal expense in the amount of $6,035.75 and for additional interest at the rate of 6.75% per annum from November 15, 2009, until the date of foreclosure sale, and for additional legal expense for the Plaintiff to conclude the foreclosure action plus all payments, costs and expenses through the date of said Special Master's Sale paid or to be paid by the Plaintiff and/or the Special Master incident to the administration, supervision, preservation and protection of the Subject Real Property, plus the cost and expenses of conducting the sale and cost of publication. SECOND NOTICE OF SALE NOTICE IS HEREBY GIVEN that pursuant to the Agreed Order of Foreclosure, Order Postponing Sale and Appointment of Special Master entered on November 30, 2009, the undersigned Special Master will sell at public auction, for cash or certified funds, at the hour of 11:00 a.m. on January 28, 2010, at the main entrance of the Bernalillo County Courthouse, 400 Lomas NW, Albuquerque, New Mexico, the real property situated in Bernalillo County, New Mexico described as follows: Lots numbered Three Hundred Seventy-seven (377), Three Hundred Seventy-eight (378) and Three Hundred Seventy-nine (379) in block numbered Thirty-Three (33) of the Perfecto Armijo and Brothers Addition to the City of Albuquerque, New Mexico, as the same are show and designated the Map of said Addition filed in the Office of the Probate Clerk and Ex-officio Recorder of Bernalillo County, New Mexico, on the 8th of July 1887, commonly known as 601 and 603 Marble Avenue and 901, 905 and 909 Sixth Street, Albuquerque, New Mexico (collectively the "Marble Property").
