NEW MEXICO FINANCE AUTHORITY Categorical Exclusion Determination Statement of Finding DW-5459 City of Belen West Aragon Road Waterline Replacement Date: April 4, 2021 Project Number: DW-5459 Introduction: The New Mexico Finance Authority (NMFA) has conducted a review of the City of Belen's (the City's) proposed waterline replacement project along West Aragon Road in accordance with the National Environmental Policy Act (NEPA) and the New Mexico State Environmental Review Process (SERP) for the Drinking Water State Revolving Loan Fund (DWSRLF). The procedure is based on the implementing regulations for NEPA (40 Code of Federal Regulations [CFR] Parts 6, 25, 35, and 1500) as followed by the Environmental Protection Agency (EPA). NMFA has determined that this project is eligible for a Categorical Exclusion (CE). Accordingly, the project is exempted from further substantive environmental review requirements under 40 CFR Part 6.107(d)(1) and 6.505(b)(1). Following is a description of the proposed action and a statement of how the action meets the criteria for a CE. Project Description and Background: The City has applied to the DWSRLF to finance the cost of replacing an asbestos cement (AC) waterline along West Aragon Road between Mesa road to the west, and NM 314 to the east. The new waterline would consist of a 12-inch PVC line, measuring approximately 3,500 feet in length. The new lines would be placed adjacent to the existing lines, which would be left in place. All activities would occur within existing utility corridors, and additional ground disturbance is not anticipated. The project would upgrade an outdated waterline, provide reliable infrastructure, and reduce future maintenance costs for the City. Project Costs: The City has received funding from the DWSRLF for $586,700.00 for the proposed waterline replacement. Categorical Exclusion Determination: CEs are identified categories of actions that do not individually, cumulatively over time, or in conjunction with other federal, state, local, or private actions, have a significant effect on the quality of the human environment. For a project to be eligible for a CE under the DWSRLF, it must meet the criteria described in 40 CFR Part 6.107 and 6.505. NMFA has performed a review of the application materials and has determined that the proposed action fits within the category of actions described by the CE and that no extraordinary circumstances are involved. The proposed action is in a category of actions that are solely directed toward minor rehabilitation of existing facilities or functional replacement of equipment. Specifically, the proposed action includes 3,500 feet of 12-inch PVC waterline. Approval: The conclusions presented here are based on the findings of an independent review of the application materials, including a CE checklist and supporting documentation, for the proposed action. Based on the independent review, the proposed action qualifies as a CE and no extraordinary circumstances exist that would prevent the issuance of this CE Determination. Therefore, this documentation will serve as a record stating that the proposed action may be categorically excluded from the environmental review process because the action fits within an eligible category. The responsible official shall revoke a CE and shall require a full environmental review if, subsequent to the granting of an exclusion, the responsible official determines that (1) the proposed action no longer meets the requirements for a CE due to changes in the proposed action; or (2) determines from new evidence that serious local or environmental issues exist; or (3) that federal, state, local, or tribal laws are being or may be violated. The documentation to support this decision will be on file at the NMFA and is available for public review upon request. RESOLUTION NO. 4-1-21.8 A RESOLUTION APPROVING THE CREATION OF PRECINCT BOUNDARIES WHEREAS, A precinct shall be divided or its boundaries adjusted if the precinct had more than 750 votes cast of the precinct at the two most recent General Elections. Adjustments of precinct boundaries are being proposed by research & polling, pursuant to NMSA 1978 Section 1-3-1 et seq; and WHEREAS, NMSA 1978 Section 1-3-1 et seq of the New Mexico Election Code empowers the Board of County Commissioners to create, organize, change, or combine or divide precincts; and WHEREAS, pursuant to the New Mexico Election Code, the County Clerk in conjunction with her work with Research and Polling, have made a determination that Precincts must be created with new Precinct Numbers to include the new Precincts splits of 33, 35,37, 50,67,69, 71, 72, 75,80,81, 84, 92, 98,100,118,138; and WHEREAS, these changes are being recommended in order to meet the requirements of upcoming redistricting reapportionment. The recommended changes by the County Clerk along with a map and Precincts and New Changes List are found in the County Clerk's Office; and NOW, THEREFORE, BE IT RESOLVED that the Sandoval County Board of Commissioners does hereby endorse and approve the changes to the precincts and existing precincts listed above; IT IS FURTHER RESOLVED that a certified copy of this Resolution will be forwarded to the New Mexico Secretary of State, along with the map and new name list.
