General Services Department/Risk Management Division is accepting proposals: Under Request for Proposals (RFP) solicitation number 16-350-4905-0001, the General Services Department, Risk Management Division is accepting competitive sealed proposals to provide adjuster services. The term of the resulting contract will be for four (4) years. In accordance with the General Services Department Strategic Plan which mandates Risk Management Division to protect and conserve the State of New Mexico's human and physical resources and financial assets by providing multi-line insurance coverages and legal defense, and in support of the Risk Management Division's core services of providing state insurance, defense of public employees in covered law suits, and providing loss control training and claim prevention services. If awarded, a contract, Offeror(s) agree to provide claims adjusting services as set forth in Section I, Paragraph C of this RFP. This procurement will result in a multiple source award. The RFP and the Proposals are hereby incorporated into this agreement to the extent their provisions are not inconsistent with the Agreement. Services will be performed at various geographic locations throughout the State. An evaluation of the Contractor's services that have been delivered under this Agreement will be monitored by the Agency's Internal File Handlers and undertaken by the Manager of the RMD Property and Casualty Bureau from time to time in the discretion of RMD. The Contractor's evaluation will be based on the quality of performance undertaken in one or more closed case(s) that are chosen in the discretion of the Manager of the RMD Property and Casualty Bureau. The following factors will be evaluated as to quality and timeliness: a. Acknowledgment of assignments shall be confirmed within 3 business days of Assignment. b. Reports will be timely transmitted electronically in the format directed by the Agency's internal file handler and contain quality information, i.e. coverage, site visits, photos, document collection, interview statements, liability assessments, reserve recommendations and next report due date. c. Adjusters shall identify potentially sources of defense and indemnity protection and issue timely tenders to the responsible party and that party's insurer, with copy to the Agency's internal file handler. d. Adjusters shall initiate subrogation attempts with appropriate follow-up. Upon immediate determination of subrogation interests. This includes putting the adverse carrier on notice. e. In appropriate circumstances, Adjusters shall recommend to the Agency's internal file handler that a claim be denied. At the direction of the Agency's internal file handler, the Adjuster shall issue notice of denial to the insured or third party claimant with copy to the Agency's internal file handler and, insured agency contact. f. Adjuster(s) must agree to execute the HIPAA Business Associates Agreement included in Appendix G. g. Professionalism must be displayed during course of adjusting with the States' insured entities. Geographically, services are required throughout the State of New Mexico. At the direction of the Agency's internal file handler, Contractors shall investigate and adjust claims against state insured entity for personal liability, casualty liability, or property losses or damages. Contractors shall examine claims forms and other records to determine insurance coverage and identify other potential sources of defense and indemnity protection. Contractor shall interview, either by person, telephone or correspondence, claimant and witnesses. Contractor shall consult with police and medical professional personnel to request copies of pertinent records, Contractor shall review pertinent police and medical records. Contractor shall inspect property for damages to determine extent of agencies liability, varying the method of investigation according to the requirements of the type of insurance involved. Contractor shall assist the Agency in pursuing subrogation, salvage or other recovery methods at the direction of the Agency's internal file handler. Contractor shall negotiate settlement with claimant. Contractor shall return reports to the Agency in the form and manner as directed by the Agency. Contractor must be licensed and is constrained by the procedures and requirements of state statute NMSA 1978, Section 59A-11-1 et. Seq. New Mexico Human Services Department Medical Assistance Division is providing this notice for the purpose of receiving comments regarding its proposed Medicaid State Plan amendment to recognize same-sex couples as spouses, if they are legally married, for purposes of making Medicaid eligibility determinations. This provision will also govern the MAD's definition of marriage for post-eligibility issues, including spousal impoverishment, asset transfers and estate recovery rules, to the degree permitted by New Mexico law. The second purpose of SPA 15-03 is to clarify that those individuals whose eligibility for Medicaid is based on eligibility for another benefit program, and for whom MAD does not complete a determination of income for Medicaid eligibility, HSD will not make any determination concerning marital status. The New Mexico Human Services Department Medical Assistance Division (MAD) is providing this notice for the purpose of receiving comments on proposed rate increases for some primary care providers who provide primary care services. The New Mexico Medicaid program will extend the primary care increase as defined in section 1202 of the Affordable Care Act (ACA) which amended sections 1902(a) (13), 1902(jj), 1905(dd) of the Social Security Act as it has been in place for 2013 and 2014. MAD intends to continue this program through 2015 and beyond using the Medicare fee schedule in effect for dates of service for January 1st for each of the extension years as the primary care payment rate. Once approved by the Centers for Medicare and Medicaid Services (CMS) the rate increases for the primary care services will be implemented effective January 1, 2015, if permitted by Centers for Medicare and Medicaid Services (CMS), or later as approved by CMS. A provider may be eligible for the primary care increase in either of two ways: (1). A provider board certified in family medicine, internal medicine, or pediatric medicine by the American Board of Medical Specialties (ABMS), the American Board of Physician Specialties (ABPS) or the American Osteopathic Association (AOA), including any subspecialty of those designations; if the provider also attests that he or she is practicing in that board certified specialty; or (2) If not board certified as indicated above, the provider can attest to practicing in the specialty areas of family medicine, general internal medicine, or pediatric medicine, and that specific primary care evaluation and management (E&M) services and vaccine administration services are at least 60 percent of the procedure codes he or she has billed the Medicaid program (fee for service and managed care programs, combined) during the most recent prior calendar year (2014); or, for new providers, the prior month. The New Mexico Human Services Department's (HSD) through the Medical Assistance Division (MAD) is accepting written comments through April 24, 2015, regarding the proposed New Mexico Statewide Transition Plan (Transition Plan) in order to bring the program into compliance with the Centers for Medicare and Medicaid Services (CMS) Final Rule 2249-F/2296-F. In January 2014, CMS instituted its final rule which for the first time defines settings that would meet the standards of "community-based". These standards address the quality of the experience for the eligible recipient, as opposed to the physical characteristics of the settings in which services were received. The final federal rule applies to both residential and non-residential settings. The intent of this rule is to ensure that eligible recipients receiving federally funded home and community-based services (HCBS) have opportunities to access community services in the most integrated settings. This will include opportunities to seek employment and work in competitive settings, engage in community life, control personal resources, and participate in the community to the same extent as people who do not receive HCBS. CMS has allowed New Mexico to submit its final Transition Plan by June 1, 2015 and is expected to be fully compliant with all requirements by March 17, 2019. The Transition Plan provides a comprehensive set of activities with specified target dates to enable HSD to come into full compliance with the HCBS final rule by March 17, 2019 for the Mi Via Waiver, the Developmental Disabilities Waiver, the Medically Fragile Waiver, and the Centennial Care Demonstration Waiver. HSD anticipates folding the Medically Fragile Waiver into the current Centennial Care Demonstration Waiver, and as such, this waiver will be incorporated into the Centennial Care Demonstration Waiver specific part of the Transition Plan. HSD is committed to fostering meaningful stakeholder engagement in implementing its Transition Plan not only by requesting your comments, but by specifically reaching out to the leading advocacy groups of the Advisory Council on Quality for the Mi Via Waiver and the Developmental Disabilities Waiver and the Member Advisory Boards for Centennial Care. HSD will use a multi-phase approach to implement the Transition Plan's assessment activities. Throughout the Transition Plan's phases HSD will: (1)Assess all applicable HSD documents governing operation and administration of the programs against the HCBS final federal rule requirements to determine compliance. This will include New Mexico Administrative Code rules, standards, procedures, the applicable HCBS waiver applications, HSD managed care organizations (MCO) contracts, Centennial Care special terms and conditions, and the MCO policy manual. Assess settings where eligible recipients receive waiver services against the HCBS final federal rule by conducting provider and eligible recipient surveys. To assist providers and eligible recipients complete the surveys, HSD will utilize its existing tools and processes and also provide training and assistance. (2)Develop strategies to remediate settings that are determined to be noncompliant with the HCBS final federal rule and the Transition Plan, to include among other options the relocations of eligible recipients to HCBS compliant settings, require noncompliant HCBS providers to implement HSD approved corrective action Transition Plans, and modify existing MCO contractual requirements. (3)Implement remediation strategies. (4)Monitor ongoing compliance against the Transition Plan. As the Transition Plan unfolds, it may be necessary to modify its tasks. HSD will provide opportunities for public and tribal comments prior to submitting Transition Plan modifications to CMS for its review and approval.
