Santa Fe Civic Housing (SFCHA) - will convene a public hearing to discuss the Annual Plan on March 19, 2014. The SFCHA Plan is a comprehensive guide to public housing agency policies, programs, operations and strategies for meeting local housing needs and goals. BEFORE THE NEW MEXICO PUBLIC REGULATION COMMISSION IN THE MATTER OF CENTURYLINK QC'S PETITION FOR APPROVAL OF AMENDMENTS TO THE QWEST PERFORMANCE ASSURANCE PLAN Case No. 13-00343-UT NOTICE OF OPPORTUNITY TO FILE RESPONSES TO CENTURYLINK QC'S REQUEST FOR SUMMARY APPROVAL OF AMENDMENTS TO THE QWEST PERFORMANCE ASSURANCE PLAN (Responses due no later than February 14, 2014) On October 16, 2013, Qwest Corporation d/b/a CenturyLink QC ("CenturyLink") filed with the New Mexico Public Regulation Commission ("Commission" or NMPRC) a petition for approval of amendments to the Qwest Performance Assurance Plan (PAP) and Performance Indicator Definitions (PIDs). CenturyLink requests in the petition that the Commission replace the existing New Mexico-approved PAP and PIDs with the PAP and PIDs approved by the Colorado Public Utilities Commission (CPUC) by order entered June 17, 2013. The Colorado-approved PAP with modified PIDs (or "Revised PAP") was the product of a settlement agreement (the "multi-state settlement") between CenturyLink, a number of competitive local exchange carriers (CLECs) and the CPUC Staff. The settling parties agreed the changes to the PAP and PIDs should be adopted in the other thirteen states in which CenturyLink functions as a Regional Bell Operating Company (RBOC). On December 19, 2013, CenturyLink filed a motion requesting that this Commission approve the Revised PAP on a summary basis without further proceedings, evidentiary or otherwise. The motion explained the instant petition was based on the multi-state settlement first approved by the CPUC and then subsequently endorsed by state commissions in ten of the fourteen RBOC states. In a supplement to the motion filed January 3, 2013, CenturyLink stated it had received no objections to its motion for summary approval of the Revised PAP; likewise, according to CenturyLink, no objec-tions had been asserted in any of the other states in its RBOC region. Further, CenturyLink said no other state had required or held an evidentiary hearing prior to approving the modified PAP and PIDs. CenturyLink also pointed out that two of the three remaining states in the RBOC region, North Dakota and Washington, had approved the multi-state settlement since the filing of the motion for summary approval with this Commission. On January 9, 2014, the undersigned Hearing Examiner held a status conference in this matter. Attending the status conference were representatives of Century- Link and the Telecommu-nications Bureau Staff of the Commission's Utility Division ("Staff"). Consistent with discussions held among the parties during the status conference, the Hearing Examiner entered an Order in this docket on January 13, 2014 that, inter alia, directed Staff to file a formal response to CenturyLink's motion for summary approval of the multi-state settlement effectuating the revised PAP and PIDs. On January 17, 2014, Staff timely filed its response to CenturyLink's motion and supplement. Staff recommends in its detailed submission, among other things, that: (i) the Commission approve the revised PAP and PIDs in conformity with the multi-state settlement; (ii) any interconnection agreements in effect that contain the previously approved PAP automatically be deemed to reflect the revised PAP and PIDs; (iii) the Commission provide, prior to approval of the revised PAP and PIDs, other potentially interested parties a brief comment period to Staff's recommendation in this case; and (iv) the Commission require CenturyLink to file a report detailing the performance of the Revised PAP six months following the adoption of the multi-state settlement to allow any interested party or the Commission the opportunity for further review of the Revised PAP if necessary.
