Bid lot one is for all materials and labor needed to perform weekly or monthly monitoring of the landscaping and irrigation portion of the Hahn Arroyo between Comanche and California. INVITATION FOR BIDS Bid # 2013-01B NOTICE is hereby given that the Village of Ruidoso, Lincoln County, New Mexico calls for sealed bids on: Lower Camelot Pressure Reducing Station The Project consists of constructing the installation of approximately 150 LF of 6-inch AWWA Class 250-Ductile Iron Mechanical Joint (DI-MJ) waterline, approximately 6 LF of 8-inch AWWA Class 250 DI-MJ waterline in the locations shown on the construction drawings, and one (1) complete 8-inch x 4-inch pressure reducing valve station, with all associated valves, fittings, appurtenances, precast concrete structure, excavation, backfilling, grading, electrical & controls and site restoration. NMSA 1978 provides that counties may adopt ordinances, not inconsistent with statutory or constitutional limitations placed on counties, to discharge those powers necessary and proper to provide for the safety, preserve the health, promote the prosperity and improve the morals, order, comfort and convenience of the County and its inhabitants; and, WHEREAS, NMSA 1978, Section 66-7-9 provides that the Motor Vehicle Code shall not be deemed to prevent local authorities for reasonable exercising police power with respect to streets and highways under their jurisdiction; and, WHEREAS, NMSA 1978, Section 66-1-4.10 provides that "local authorities" means every county, municipality and any local board or body having authority to enact laws relating to traffic under the constitution and laws of this state." Bd. Of Comm'rs v. Greacen, 2000-NMSC- 016, 129 N.M. 177, 3 P.3d 672 (2000) (County has all of the powers of a "local authority"); and, WHEREAS, NMSA 1978, Section 4-37-2 provides in part, that "County ordinances are effective within the boundaries of the county, including privately owned land or land owned by the United States."; and, WHEREAS, NMSA 1978, Section 7-38-42 provides that the "county treasurer has the responsibility and authority for collection of taxes and any penalties or interest due under the Property Tax Code [Chapter 7, Article 35 to 38 NMSA 1978] except for the collection of delinquent taxes, penalties and interest authorized to be collected by the department under Section 7-38-62 NMSA 1978"; and, WHEREAS, the Board of the County Commissioners has determined that the health, safety, prosperity and general welfare of the residents of Bernalillo County would be best served by the adoption of a Bernalillo County Mobile Home Movement Ordinance. NOW THEREFORE BE IT ORDAINED that the Board of County Commissioners establish a Bernalillo County Mobile Home Movement Ordinance for Bernalillo County as follows: ARTICLE 1. TITLE This ordinance may be cited as the "Bernalillo County Mobile Home Movement Ordinance" (hereinafter, "this Ordinance"). ARTICLE 2. PURPOSE AND SCOPE The general purpose of this Ordinance is to provide a method to facilitate the County of Bernalillo's collection of property taxes on mobile homes within the jurisdiction of the County. This Ordinance applies to all streets, highways, county roads and public roads within the geographic boundaries of Bernalillo County. ARTICLE 3. DEFINITIONS For the purposes of this Ordinance, the following words shall have the following specified meanings: Mobile Home: "mobile home" means a movable or portable housing structure, constructed to be towed on its own chassis and designed to be installed with or without a permanent foundation for human occupancy as a residence, and includes structures referred to as "manufactured homes"; it may include one or more components that can be retracted for towing purposes and subsequently expanded for additional capacity, or two or more units separately towable but designed to be joined into one integral unit, as well as a single unit, except that "mobile home" does not include recreational vehicles, or modular or premanufactured homes built to Uniform Building Code standards and designed to be permanently affixed to real property; Owner: means any person, association, partnership or corporation that has dominion over, control of, or title to real or personal property. Person: an individual, partnership, joint venture, corporation, association, social club, fraternal organization, trust, estate, receiver, or any other legal entity. Responsible person: any owner, user, seller, purchaser, lessee, lessor, renter or agent or employee thereof, or other person in control of a mobile home. CONTINUATION PAGE 3, ARTICLE 4. MOVEMENT OF MOBILE HOME FROM COUNTY WITHOUT CERTIFICATE PROHIBITED Section 4.1 Except as provided in Section 4.2 of this ordinance, no responsible person shall permit or conduct the movement of a mobile home through Bernalillo County unless and until the owner of such mobile home or his authorized agent obtains and attaches a certificate, as described below, to the rear of the mobile home in a location that is conspicuous. Said certificate shall be affixed to the mobile home during all times the mobile home is being mobilized over the public streets, highways, county roads and public roads within Bernalillo County. Attachment of a bona fide certificate similar to the certificate described in Article 5 of this Ordinance that is issued by the Treasurer of another County within the State of New Mexico, and which is attached and described herein, shall constitute compliance with the requirements of this Section. Section 4.2 Exception. The movement of a mobile home from the lot or business of a mobile home dealer to its destination designated by an owner-purchaser is not subject to the requirements of Section 4.1, above, if the movement originated from the lot or business location of the dealer and the mobile home was part of his inventory prior to the sale to the owner18 purchaser. The movement of a mobile home by a dealer or his authorized agent as a result of a purchase or trade-in from a non-dealer owner is subject to the requirements of this ordinance regardless of the destination. ARTICLE 5. CERTIFICATE. Section 5.1 Form of Certificate. The certificate from the County Treasurer shall be of a size and color to be prescribed by said Treasurer and shall contain an expiration date which shall be no later than thirty (30) days from the date of issuance. Section 5.2. Application; Form. No certificate shall be issued by the County Treasurer unless the applicant has completed an application, upon a form approved by the County Treasurer. The form shall specify the municipal address or county address from which the mobile home is being moved. The form shall also specify the municipal address or county address to which the mobile home is being moved; provided that if the destination is a location for which an address is not available, then the person requesting the certificate shall give a physical description of the destination sufficient to enable the County Treasurer to identify the actual site or location to which the mobile home is being moved. ARTICLE 6. ENFORCEMENT Section 6.1. Enforcing Entities. The Mobile Home Tax Recovery Specialists, within the Bernalillo County Treasurer's Office, or the Sheriff's Department, or any duly authorized law enforcement officer shall have authority to enforce the provisions of this Ordinance. Section 6.2. Burden of Proof. Unless otherwise provided herein, the burden of establishing a violation of this Ordinance has occurred is on the enforcing entity, who shall establish that the individual charged has violated this Ordinance beyond a reasonable doubt. CONTINUATION PAGE 4, Section 6.3. Reporting Alleged Violations. Any person may report an alleged violation of this Ordinance to the Treasurer's Office or the Sheriff's Department. Upon receipt of such report, the Treasurer's Office or the Sheriff's Department shall ascertain the location, date, time and specific nature of the alleged violation. Section 6.4. Authority of Enforcing Entity. If an investigation determines that a violation of this Ordinance exists, the enforcing entity shall have the authority to issue a written citation for violation of this Ordinance. Section 6.5. Penalty for Violation. Each violation of this Ordinance shall be punishable by a fine of no more than three hundred dollars ($300), and/or imprisonment for no more than ninety (90) days, or both. Section 6.6. Other Remedies Not Affected. Other remedies as may be provided by law, for any conditions described in this Ordinance, are not affected by the terms of this Ordinance. Prosecution or conviction under this ordinance shall not discharge the obligation for the payment of any taxes due under the laws of the State of New Mexico. ARTICLE 7. SAVINGS CLAUSE. If any article, section, paragraph, clause, word or phrase of this Ordinance is held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance. ARTICLE 8. REPEALER. Any and all other prior ordinances directly contradicted by this Ordinance are hereby repealed. ARTICLE 9. EFFECTIVE DATE. APS implements an Operations and Maintenance Program to train custodial and maintenance personnel in the proper work practices and controls for the safe handling of Asbestos.
