ALBUQUERQUE-BERNALILLO COUNTY AIR QUALITY CONTROL BOARD NOTICE OF HEARING AND MEETING On September 12, 2012 at 5:30 PM, the Albuquerque-Bernalillo County Air Quality Control Board (Air Board) will hold a public hearing in the Vincent E. Griego Chambers (City Council/County Commission Chambers) at the Albuquerque/Bernalillo County Government Center, 400 Marquette Avenue NW, Albuquerque, NM 87102. The hearing will address a proposal to amend 20.11.82 NMAC, Rulemaking Procedures-Air Quality Control Board. The purpose of the hearing is to receive testimony on a proposal to amend 20.11.82 NMAC, Rulemaking Procedures-Air Quality Control Board. The amendments proposed to this regulation include clarification of definitions and procedures; mirroring language in the Environmental Improvement Board rulemaking regulation when possible for the sake of consistency; changing the number of copies required for service of documents to be consistent throughout the regulation; distinguishing between technical and non-technical testimony in the section on "Participation by General Public"; extending the number of days allowed for filing a motion seeking a stay of a rule adopted by the Board from 15 to 30 days; making a clearer distinction between "person", "participants" and "parties" throughout the regulation; and clarifying the procedure for "Stay of Board Regulations". After the hearing closes the Air Board is expected to convene its regular monthly meeting during which they will consider adopting the proposed amendments to 20.11.82 NMAC, Rulemaking Procedures-Air Quality Control Board. The Air Quality Control Board is the federally delegated air quality authority for Albuquerque and Bernalillo County. ALBUQUERQUE-BERNALILLO COUNTY AIR QUALITY CONTROL BOARD NOTICE OF HEARING AND REGULAR MEETING On September 12, 2012, at 5:30 pm, the Albuquerque-Bernalillo County Air Quality Control Board (Air Board) will hold a public hearing in the Vincent E. Griego Chambers located in the basement level of the Albuquerque-Bernalillo County Government Center, 400 Marquette Avenue NW, Albuquerque, NM. The hearing will address: Proposal to amend 20.11.3 NMAC, Transportation Conformity, and to incorporate an amended 20.11.3 NMAC into the New Mexico State Implementation Plan (SIP) for air quality. The Air Quality Division (AQD) of the City of Albuquerque Environmental Health Department is proposing these amendments in response to the promulgation by the U.S. Environmental Protection Agency (EPA) of an amended federal transportation conformity rule. On March 14, 2012, the EPA promulgated changes to the transportation conformity rule. This rule became effective on April 13, 2012 [FR Vol. 77, No.50, 14979-14988]. In response, and as required by EPA, the AQD is proposing amendments to update the local conformity regulation. EPA's updated rule: The EPA has finalized changes to the transportation conformity rule to make the rule apply to any future new or revised national ambient air quality standards (NAAQS). The final rule restructures two sections of the transportation conformity rule so that existing requirements will apply for any new or revised NAAQS. Restructuring these sections will reduce the need to amend the rule in the future merely to reference a specific NAAQS and will provide more certainty to transportation planners without compromising environmental benefits. This final rule ensures that air quality is protected and clarifies requirements for implementers. EPA has worked closely with the U.S. Department of Transportation to develop this final rule. Background Transportation conformity is a Clean Air Act requirement that ensures that federally supported highway and transit projects are consistent with SIPs. Conformity helps protect public health through early consideration of the air quality impacts of transportation decisions in places where air quality does not currently meet federal standards or has not met them in the past. Key Elements of the Final Rule The final rule primarily restructures two sections of the conformity rule, 20.11.3.109 NMAC [40 CFR 93.109] and 20.11.3.119 NMAC [40 CFR 93.119], so that the existing rule requirements clearly apply to areas designated for future new or revised NAAQS, thus reducing the need to amend the transportation conformity rule merely to reference specific new NAAQS. As a result of these changes, the conformity rule will apply to any new NAAQS that EPA establishes in the future. This rule also allows PM2.5 areas with clean air quality data to take advantage of conformity flexibilities that are currently available only to ozone areas. Health and Environmental Benefits The final rule ensures that transportation activities are consistent with air quality goals of the transportation conformity program. The final rule ensures that all nonattainment and maintenance areas use conformity tests that ensure air quality progress continues in areas that need to attain or maintain the NAAQS. Following the hearing, the Air Board will hold its regular monthly meeting during which the Air Board is expected to consider adopting the proposed amendments to 20.11.3 NMAC, Transportation Conformity, and incorporating the amended regulation into the SIP. BERNALILLO COUNTY REQUEST FOR PROPOSAL (RFP) #10-13-PL, Professional Engineering Services regarding Goff Roadway Improvements Project Bernalillo County Purchasing Department on behalf of the Public Works Division, Technical Services Department is seeking competitive solicitations, with qualified Offeror's to provide Professional Engineering Services regarding Goff Roadway Improvements Project. Engineering Services for the design of "Goff Roadway Improvements" shall consist of roadway improvements between Bridge Boulevard and the Isleta/Arenal/Goff intersection. These roadway improvements shall consist of the widening of Goff Road from 2 lanes to 3 lanes and the addition of curb and sidewalk on each side of the roadway to improve safety and capacity of the roadway. Storm drainage design for Goff Road shall be based upon the recommended option from the "Sanchez Farm Pond Design Analysis Report" prepared by Thompson Engineering Consultants, Inc. Such improvements shall include a new storm drain within Goff Road that will ultimately discharge into the Sanchez Farm Pond via Arenal Road along with proposed detention pond locations. NEW MEXICO FINANCE AUTHORITY Categorical Exclusion Determination Statement of Finding Date: July 9, 2012 City of Las Vegas Infrastructure Project Las Vegas, San Miguel County, New Mexico Project Number: 2727-DW The New Mexico Finance Authority (NMFA) has conducted a review of the proposed City of Las Vegas (City) infrastructure project in accordance with the National Environmental Policy Act (NEPA) and the New Mexico State Environmental Review Process (SERP) for the State Drinking Water Revolving Loan Fund (DWRF). The procedure is based on the implementing regulations for NEPA (40 Code of Federal Regulations [CFR] Parts 6, 25, 35, and 1500) as followed by the Environmental Protection Agency, USDA Rural Utility Service Bulletin 1794A-602 and State regulations 20.7.7 NMAC. NMFA has determined that this project is eligible for a Categorical Exclusion (CE). Accordingly, the project is exempted from further substantive environmental review requirements under 40 CFR Part 6.107(d)(1) and 6.505(b)(1). Following is a description of the proposed action and a statement of how the action meets the criteria for a CE. Project Description and Background: The City has applied for a drinking water loan for the replacement of 6,863 manual-read meters with radio-read meters. The new meters will provide more accurate data and would reduce the amount of labor required for the existing manual-read meters. The new radio-read meters have a leak detection feature as was as reverse flow features. The City water system currently has an estimated unaccounted water loss of 25-percent. The replacement of the manual-read meters will allow the City to reallocate the labor required to read meters to repairing and/or replacing leaking water lines. This plan will reduce water loos by approximately ten to fifteen-percent. City personnel will also be able to put more effort into programs that support water conservation and reduce high water consumption. The proposed project will not require ground disturbance, will occur within existing right-of-way, and will not result in any environmental impacts. Project Costs: The City is requesting funding form the DWRLF for $1,100,000 for the purchase of radio-read meters and replacement lids. Categorical Exclusion Determination: Categorical Exclusions are identified categories of actions that do not individually, cumulatively over time, or in conjunction with other federal, state, local, or private actions have a significant effect on the quality of the human environment. For a project to be eligible for Categorical Exclusion under the DWRLF, it must meet the criteria described in 40 CFR Part 6.107and 6.505. NMFA has performed a review of the application materials and has determined that the proposed action fits within the category of actions described by the CE and that no extraordinary circumstances are involved. The proposed action fits within a category of actions which are solely directed toward minor rehabilitation of existing facilities, functional replacement of equipment, or towards the construction of new ancillary facilities adjacent or attached to existing facilities. Specifically, the proposed action includes the replacement of water meters within existing easements and will not affect the degree of treatment or capacity of the existing facility. Approval: The conclusions presented here are based on the findings of an independent review of the application materials, including a CE checklist and supporting documentation for the proposed action. Based on the independent review, the proposed action qualifies as a CE and no extraordinary circumstances exist that would prevent the issuance of this CE Determination. Therefore, this documentation will serve as a record stating that the proposed action may be categorically excluded from the environmental review process because the action fits within an eligible category. The responsible official shall revoke a categorical exclusion and shall require a full environmental review if, subsequent to the granting of an exclusion, the responsible official determines that: (1) The proposed action no longer meets the requirements for a categorical exclusion due to changes in the proposed action; or (2) determines from new evidence that serious local or environmental issues exist; or (3) that Federal, State, local, or tribal laws are being or may be violated.
