Notice is hereby given that on May 16, 2011, Sunset Hills Estates Homeowners Assoc., Contact Chris Thornton, 9621 Desert Mountain Road, NE, Albuquerque, NM, 87122, filed Application No. RG-61356 with the STATE ENGINEER for Permit to Change Location of Well within the Middle Rio Grande Underground Water Basin. The applicant proposes to discontinue the use of RG-61356 located within the SE 1/4 NE 1/4 SW 1/4 of Section 9, Township 11 North, Range 4 East, NMPM, also described as X=417,400 feet, Y=1,5257,00 feet, N.M. Coordinate System Central Zone in the Elena Gallegos Grant, and commence the use of proposed Well RG-61356 to be drilled approximately 1000 feet deep, with a 4.5 inch casing, and approximately 30 feet from Well No. RG-61356, located at a point where X=417,400 feet, Y=1,525,700 feet, N.M.C.S. Central Zone, NAD 27, both in the Elena Gallegos Grant, for the continued diversion of 34 (31) acre-feet of water per annum for domestic and residential household usage and landscape irrigation on 35 acres of land, in Section 8 & 9, Township 11 North, Range 4 East, NMPM. The applicant requests the change of location of well for the following reasons: "Our attempt to remove and replace the perforated well casing from the current location failed, with a portion of the damaged casing falling back down the well. The current well hole is not repairable. This well had served as a supplemental well, providing a "hot back-up" to the homeowners association's primary well RG61356S, currently serving 26 households in the Sunset Hills Estates neighborhood (29 upon the construction of the three remaining empty lots). In the event our primary well might require any significant downtime for repair, we would be forced to haul in water at a significant expense to the community." The applicant is not requesting an increase in diversion and the purpose for relocation is to "improve the robustness of the community's water system." Both the proposed and existing wells and place of use are owned by the applicant and generally located between Elena Drive and the south boundary of the Sandia Pueblo Grant between Ventura St. and Eubank St., Bernalillo County, New Mexico. Any person or other entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) Be detrimental to the objector's water right; or (2) Be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that the objector shows how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible, signed, and include the complete mailing address of the objector. An objection or protest must be filed with the state engineer not later than 10 calendar days after the date of the last publication of this notice. An objection or protest may be mailed to the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109-4127 or faxed to (505) 383-4030 provided the original is hand-delivered or postmarked within 24 hours after transmission of the fax. The State Engineer will take the application up for consideration in the most appropriate and timely manner practical. Jorunal: June 2, 9, 16, 2011.
