VILLAGE OF ANGEL FIRE, NEW MEXICO CALLING FOR A SPECIAL MAIL BALLOT-ONLY ELECTION TO BE HELD IN THE VILLAGE OF ANGEL FIRE, NEW MEXICO ON MAY 12, 2009, CONCERNING THE PROPOSED ISSUANCE OF GENERAL OBLIGATION BONDS IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $4,500,000 FOR THE PURPOSE OF PAYING FOR THE DESIGN, ENGINEERING, CONSTRUCTION AND OTHERWISE IMPROVING OF ROADS AND RELATED IMPROVEMENTS; PROVIDING THE FORM OF THE BOND QUESTION; PROVIDING FOR NOTICE OF THE SPECIAL ELECTION; PRESCRIBING OTHER DETAILS IN CONNECTION WITH SUCH ELECTION AND BONDS; AND RATIFYING ACTION PREVIOUSLY TAKEN IN CONNECTION THEREWITH. WHEREAS, the Village Council (the "Governing Body") of the Village of Angel Fire (the "Village") in Colfax County (the "County"), State of New Mexico (the "State"), hereby determines that it is necessary and in the best interests of the Village and its inhabitants to incur indebtedness in the principal amounts and for the purpose provided herein; and WHEREAS, in accordance with the provisions of Section 6-15-1 NMSA 1978, the Governing Body acting by and through the Village Administrator has forwarded in writing to the Local Government Division of the Department of Finance and Administration a notice of the bond election authorized by this Resolution; and WHEREAS, the Governing Body has the authority to call a special election (the "Election") for the purpose of submitting questions of incurring indebtedness to the qualified electorate of the Village pursuant to applicable laws of the State, and pursuant to Article IX, Section 12 of the New Mexico Constitution; and WHEREAS, the Governing Body hereby determines and declares that the road improvements (the "Project"), to be financed with proceeds of the Village's general obligation bonds which are the subject of the question to be voted upon in the Election (the "Bond Question"), are for a public purpose and no bond election has been held on the Bond Question during the year immediately preceding the date established for the Election. THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE VILLAGE OF ANGEL FIRE, NEW MEXICO: Section 1.All action, not inconsistent with the provisions of this Resolution, heretofore taken by the Governing Body and the officers of the Village directed toward the Project described in the Bond Question, is ratified, approved and confirmed. Section 2.The Election shall be held in the Village on May 12, 2009. Section 3.At the Election the following question shall be submitted to the Village's qualified electors: Shall the Village of Angel Fire issue up to $4,500,000 of general obligation bonds, to be repaid from property taxes, for the design, engineering, construction and otherwise improving of roads and related improvements within the Village? FOR GENERAL OBLIGATION ROAD IMPROVEMENT BONDS? AGAINST GENERAL OBLIGATION ROAD IMPROVEMENT BONDS? Section 4.The Election will be conducted by all-mailed ballot in accordance with the Mail Ballot Election Act (Sections 1-23-1 to 1-23-7, NMSA, 1978). Section 5.The Village Clerk shall accept completed ballots until 7:00 p.m. on May 12, 2009. Section 6.The polling place for the receipt, counting, and tallying of the ballots in the Election shall be the Village Hall, 3388 Mountain View Blvd., Angel Fire, New Mexico through the office of the Village Clerk. Section 7.The Village's qualified resident electors and the Village's qualified nonresident municipal electors are eligible to vote on the Bond Question. No judge or clerk of election shall allow a person to vote unless he or she is duly registered as a voter with the County Clerk and unless he or she meets the qualifications of a resident elector or a nonresident municipal elector, as described in Sections 8 and 9 of this Resolution. Section 8.Persons desiring to vote in the Election (including nonresident municipal electors) must be registered to vote. Any person who is otherwise qualified to vote and who is not currently registered may register at the office of the County Clerk, 230 N. Third Street, Raton, New Mexico on or before 5:00 p.m. on April 14, 2009, provided, however, that the County Clerk shall accept for filing certificates of registration that are subscribed and dated on or before April 14, 2009 or that are postmarked not later than April 14, 2009 and that are received by the County Clerk before 5:00 p.m. on April 16, 2009. Section 9.A "nonresident municipal elector" means any person who on the date of the Election is a qualified, registered elector of the County but who is a resident of that portion of the County which is outside of the Village limits, and who has paid a property tax on property located within the Village during the year preceding the Election. Not more than sixty (60) nor less than fifteen (15) days before the Election, any nonresident municipal elector desiring to vote on the Bond Question shall file with the Village Clerk a completed certificate of eligibility in substantially the form provided in Section 3-30-3 NMSA 1978, which shall constitute the nonresident municipal elector's additional registration requirement for voting in the Election on the Bond Question. Each nonresident municipal elector must file such certificate of eligibility with the Village Clerk in addition to registering to vote with the County Clerk. Section 10.For the purpose of this Resolution and solely for the purpose of voting on the Bond Question, all territory within the County is a municipal precinct (hereinafter referred to as the "Municipal District"). All territory in the Municipal District and not within the Village's boundaries shall constitute one voting division to be known as the nonresident municipal elector voting precinct (hereinafter referred to as the "Nonresident Voting District"). The Nonresident Voting District shall include the territory within the boundary of any other municipality within the County. Section 11.The vote shall be canvassed as provided in Section 3-30-7 and Section 3-8-53, NMSA 1978, and the Bond Election Act, Sections 6-15-23 through 6-15-28, NMSA 1978, and the Village Clerk shall certify the results of the Election and file the Certificate of Canvass in the official minute book of the Village. Section 12.This Resolution shall be published in the English and Spanish languages at least once a week for four consecutive weeks by four insertions, the first insertion being published between fifty and sixty days before the day of the Election in a newspaper or newspapers which maintain an office in and are of general circulation in the Village and which otherwise qualify as legal newspapers in the Village. The Village Clerk is hereby instructed and authorized to carry out this provision. Section 13.The officers of the Village are hereby authorized and directed, for and on behalf of the Village, to take all action necessary or appropriate to effectuate the provisions of this Resolution, including, without limiting the generality of the foregoing, the preparation of affidavits, instructions and election supplies, and the publication of notices. Section 14.If any section, paragraph, clause or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this resolution. Section 15.All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are hereby repealed to the extent only of such inconsistency. This repealer shall not be construed to revive any bylaw, order, resolution or ordinance, or parts thereof, heretofore repealed. ADOPTED THIS 3RD DAY OF MARCH, 2009. Apartado 2.La eleccion tendra lugar en la Aldea el 12 de mayo 2009. Apartado 3.En la Eleccion la cuestion a continuacion se sometera a los votantes calificados de la Aldea: Debera emitir la Aldea de Angel Fire hasta $4,500,000 en bonos de obligacion general, que se pagaran de los impuestos sobre la propiedad inmueble, para el diseno, la ingenieria, la construccion y de otra manera mejorar los caminos y mejoras relacionadas dentro de la Aldea? A FAVOR DE BONOS DE OBLIGACION GENERAL PARA MEJORAR CAMINOS? EN CONTRA DE BONOS DE OBLIGACION GENERAL PARA MEJORAR CAMINOS? Apartado 4.La Eleccion se llevara a cabo mediante todas las boletas enviadas por correo conforme dispone la Ley de Elecciones mediante Boletas de Eleccion Enviadas por Correo. (Apartados 1-23-1 a 1-23-7, de Las Leyes de Nuevo Mexico Glosadas de 1978). Apartado 5.El 12 de mayo 2009, la Secretaria de la Aldea aceptara boletas completadas hasta las 7:00 p.m. Apartado 6.El centro de votacion para recibir, contar y concordar las boletas en la Eleccion sera la Sala de la Aldea, 3388 Mountain View Boulevard, Angel Fire, Nuevo Mexico mediante la oficina de la Secretaria de la Aldea. Apartado 7.Los votantes residentes calificados de la Aldea y los votantes calificados de la Aldea que no son residentes tendran el derecho de votar respecto a la Cuestion de Bonos. Ningun/a juez/a ni secretario/a de eleccion permitira que vote la persona salvo que el o ella este debidamente registrado/a para votar con la Secretaria del Condado y solo que el o ella llene los requisitos de votante residente o de votante municipal que no es residente, segun esta descrito en el Apartado 8 y 9 de esta Resolucion. Apartado 8.Las personas que desean votar en la Eleccion (incluso los que no son votantes del municipio que no son residentes) tienen que registrarse para votar. Cualquiera persona que de otra manera califica para votar y que actualmente no esta registrado/a puede degustarse en la oficialia de la Secretaria del Condado, 230 North Third Street, Raton, Nuevo Mexico a las 5:00 p.m. o antes de esa hora el 14 de abril 2009, sin embargo, esa Secretaria del Condado aceptara que se presenten certificados de registro que estan suscritos y fechados en o antes del 14 de abril 2009 o que tengan el sello postal a mas tardar el 14 de abril 2009 y los haya recibido la Secretaria del Condado antes de las 5.00 p.m. el 16 de abril 2009. Apartado 9.Un "votante municipal no-residente" significa cualquiera persona que en el dia de la Eleccion es votante que califica y esta registrado/a del Condado pero es residente de la parte del Condado que esta fuera de los linderos de la Aldea, y quien ha pagado impuesto sobre la propiedad inmueble localizada dentro de la Aldea durante el ano que antecede la Eleccion. No mas de sesenta (60) ni menos de quince (15) dias antes de la Eleccion, cualquier votante municipal que no es residente que desee votar respecto a la Cuestion de Bonos le presentara a la Secretaria de la Aldea, un certificado completado que tiene derecho en sustancialmente la forma que dispone el Apartado 3-30-3 de Las Leyes de Nuevo Mexico Glosadas, de 1978, el cual constituira el requisito de registro adicional de votante municipal no-residente para votar en la eleccion respecto a la Cuestion de Bonos. Cada votante municipal no-residente tendra que presentar dicho certificado a la Secretaria de la Aldea que tiene derecho de votar ademas de registrarse con la Secretaria de la Aldea para votar. Apartado 10.Para el proposito de esta Resolucion y unicamente con el proposito de votar respecto a la Cuestion de Bonos, todo el territorio dentro del Condado es un distrito municipal (de aqui en adelante referido como el "Distrito Municipal"). Todo el territorio en el Distrito Municipal y no dentro de los linderos de la Aldea constituira una division para votar que se conocera como el distrito electoral municipal para los no-residentes (de aqui en adelante el "Distrito de Votacion para los No-Residentes"). El Distrito de Votacion para los No-Residentes englobara el territorio dentro del lindero de cualquiera otra municipalidad dentro del Condado. Apartado 11El voto sera escudrinado segun dispone el Apartado 3-30-7 y el Apartado 3-8-53, de Las Leyes de Nuevo Mexico Glosadas de 1978, y la Ley de Eleccion de Bonos, Apartados 6-15-23, hasta 6-15-28 de Las Leyes de Nuevo Mexico Glosadas de 1978, y la Secretaria de la Aldea certificara los resultados de la Eleccion y archivara el Certificado del Escudrino en el libro de actas oficial de la Aldea. Apartado 12La Resolucion se publicara en ingles y en espanol por lo menos una vez por semana durante cuatro semanas consecutivas mediante cuatro inserciones, la primera insercion se publicara entre cincuenta y sesenta dias antes del dia de la Eleccion en un periodico o periodicos que tienen oficina en y son de circulacion general en la Aldea y de otro manera califican como periodicos legales en la Aldea. A la Secretaria de la Aldea por la presente se le ordena y se le autoriza que lleve a cabo esta disposicion. Apartado 13.Los oficiales de la Aldea por la presente quedan autorizados y se les ordena, por y de parte de la Aldea, que tomen toda medida necesaria o apropiada con el fine de efectuar las disposiciones de esta Resolucion, incluso, sin limitar la generalidad de lo indicado mas arriba, la preparacion de las declaraciones juradas, instrucciones y materiales que se usan en la eleccion, y la publicacion de las notificaciones. Apartado 14Si cualquier apartado, parrafo, clausula o disposicion de esta Resolucion por cualquier motivo se decide que no tiene validez o no es ejecutable, la invalidez o el hecho que dicho apartado, parrafo, clausula o disposicion no es ejecutable no afectaran cualquier de las otras disposiciones de esta resolucion. Apartad 15Todos los estatutos, ordenes, resoluciones y ordenanzas, o partes de las mismas inconsistentes con el texto de esta resolucion, por la presente son derogados hasta donde alcance dicha inconsistencia.
