NOTICE OF HEARING NEW MEXICO ENVIRONMENT DEPARTMENT The New Mexico Environment Department (NMED) has scheduled a public hearing for the limited purpose of taking additional evidence regarding the potential for surface water contamination and undue risk to property in considering the approval of the revised ground water Discharge Permit application, DP-1641, as submitted by Mr. John McCatharn, ParaSol Dairy, P.O. Box 19306, Albuquerque, NM 87119-0306. Discharge Permits are issued pursuant to New Mexico Water Quality Control Commission (WQCC) Regulations. The public hearing will be held on Thursday, February 5, 2009, 9 a.m. at the Truth or Consequences Convention Civic Center, 400 W. Fourth Street, Truth or Consequences, New Mexico. Public comment shall be taken at noon and at 6 p.m. on that day, and at other times as necessary and directed by the Hearing Officer. The public hearing shall continue into the evening and the next day, Friday, February 6, 2009, as necessary. In the revised Discharge Permit Application DP-1641, John McCatharn proposes to discharge up to 8,000 gallons per day of agricultural wastewater from the proposed ParaSol Dairy. Wastewater from the milking parlor and hospital barn gravity flows via a pipeline/concrete channel through a weeping wall separator and collects in a double synthetically lined wastewater lagoon with leak detection for storage and partial evaporation. Wastewater then flows to a single synthetically lined combination wastewater/stormwater lagoon for the purpose of disposing of wastewater by evaporation and containing a volume of stormwater runoff and direct precipitation that is, at a minimum, 25% greater than the volume generated by a 25-year, 24-hour rainfall event. In the event that the single synthetically lined combination wastewater/stormwater lagoon receives and contains stormwater runoff and direct precipitation (from a single event or multiple events) that is in excess of a volume 25% greater than the volume generated by a 25-year, 24-hour rainfall event, the permittee is authorized to discharge from the single synthetically lined combination wastewater/stormwater lagoon to four unlined contingency stormwater impoundments. Potential contaminants associated with this type of discharge include nitrogen compounds. The facility is located at ParaSol Farms, off Hwy 187, approximately 5 miles southwest of Caballo, in Sections 21 and 22, T16S, R05W, Sierra County. Ground water beneath the proposed facility is at a depth of approximately 32 - 57 feet and has a total dissolved solids concentration of approximately 240 milligrams per liter. Issuance of the original draft Discharge Permit for ParaSol Dairy, DP-1641, was denied by NMED on February 27, 2008. The applicant appealed this decision to the WQCC on March 27, 2008. The WQCC remanded the matter to NMED to take limited additional evidence regarding the potential for surface water contamination and undue risk to property. The applicant subsequently submitted a revised application removing all application of wastewater to irrigated cropland under cultivation. All interested persons will be given a reasonable opportunity at the public hearing to submit relevant evidence, data, views or arguments orally or in writing, and to examine persons who testify at the hearing. Any person who wishes to present technical evidence at the hearing shall, no later than ten (10) calendar days prior to the hearing (by 5:00 p.m. on January 26, 2009), file a Statement of Intent to Present Technical Testimony with the Hearing Clerk, Sally Worthington, NMED, Harold Runnels Building, 2nd floor, Room N-2150, P.O. The purpose of this application is to request that the water rights be retained at their move-from location for a period of ten (10) years upon approval of the transfer by the State Engineer, to include an additional five (5) year term or longer as the parties may agree, subject to approval by the State Engineer, by reason that water rights are not immediately needed for the exercise of permit RG-6745 et al. Any person or entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) be detrimental to the objector's water right; or (2) be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that they show how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible and signed, and include the mailing address of the objector.
