STATE OF NEW MEXICO COUNTY OF BERNALILLO IN THE SECOND JUDICIAL DISTRICT COURT Case No. D-202-CR-2014-01545 BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF BERNALILLO Ex Rel. BERNALILLO COUNTY SHERIFF'S DEPARTMENT, Plaintiff, v. BELINDA HALL DOB: 11/26/1970 SSN: xxx-xx-8257 Address: 1818 Williams St. SE Albuquerque, NM 87102 Defendant; IN RE: THE FORFEITURE OF $11,700.00 U.S. CURRENCY COMPLAINT OF CASH FORFEITURE COMES NOW, the County of Bernalillo, ex rel. Bernalillo County Sheriff's Department, by and through undersigned counsel, and pursuant to the Controlled Substances Act, N.M. Stat. Ann. 30-31-1, et. seq., and the Forfeiture Act, N.M. Stat. Ann. 31-27-1 et. seq., states the following: 1. On or about March 7, 2014, members of the Bernalillo County Sheriff's Department (BCSO) "HEAT" unit executed a search warrant at 1818 Williams St. SE in Albuquerque, New Mexico, in reference to an ongoing narcotics investigation. Defendant Hall was the target of that investigation and upon information and belief, this address is the location of Defendant's residence. 2. During the course of the search of Defendant's residence, large volumes of methamphetamine, multiple digital scales and drug ledgers were found in the home. Also located within the residence, were large sums of United States currency. Based on the totality of BCSO Detectives' investigations, including Defendant's statements to detectives, as well as the evidence discovered in her home, it is believed that Defendant was selling and distributing large amounts of methamphetamine out of her residence. As a result of the search and investigation, Defendant was arrested and taken into custody by BCSO deputies. 3. The March 7, 2014 search warrant led to the discovery of the aforementioned evidence that was determined to be the fruits of and/or instrumentalities of violations of the Controlled Substances Act, N.M. Stat. Ann. 30-31-1, et. seq., namely trafficking. 4. Pursuant to the above described warrant, BCSO detectives seized cash monies found within Defendant Hall's residence. In total, said monies were determined to be United States currency in the amount of $11,700.00 (eleven-thousand, seven-hundred dollars). 5. The BCSO "HEAT" unit, which is primarily responsible for the investigation of burglaries, larcenies and narcotics enforcement, is operated and overseen by members of the Bernalillo County Sheriff's Department, 400 Roma NW, Albuquerque, New Mexico, 87102. 6. Attached hereto as an exhibit, is the affidavit for search/seizure warrant, Exhibit A, "Affidavit for Search Warrant" (executed March 7, 2014) from the seizing agents regarding the seizure of the currency and other related evidence, stating more fully the legal and factual grounds for the seizure. 7. The Defendant's property/cash monies were seized by the Bernalillo County Sheriff's Deputies in Bernalillo County, New Mexico, on or about March 7, 2014. 8. This Court has exclusive subject matter jurisdiction and venue is proper in Bernalillo County. 9. The in rem defendant is the fruit of, or instrumentality of crimes involving violations of the Controlled Substances Act, and is therefore subject to seizure and forfeiture pursuant to N.M. Stat. Ann. 30-31-34. 10. In accordance with the provisions of the Forfeiture Act, said monies have been deposited with and are in the custody of the Clerk's Office of the Second Judicial District Court (See In re: In the Matter of $11,700.00 U.S. Currency, D-202-CV-2014-01801, "Petition for An Order For Deposit of Currency", filed March 11, 2014 and accompanying "Order for Deposit of Currency", signed by the Honorable Shannon Bacon, March 24, 2014), and are subject only to the Orders and Decrees of the Court. 11. The County has made an investigation to determine what person(s) may claim an ownership interest, or claim to be in charge of, or have a bona fide security interest in the above captioned monies, and has determined to the best of its knowledge that they are as follows: a. Defendant Belinda Hall, 1818 Williams St. SE, Albuquerque, NM 87102 12. The County shall prove, through clear and convincing evidence, pursuant to N.M. Stat. Ann. 31-27-6(E), that: a. The above-described cash monies are subject to forfeiture; b. Defendant will be criminally tried and convicted in this matter; c. The value of the property in question does not unreasonably exceed: i. The pecuniary gain derived or sought to be derived by the crimes alleged; ii. The pecuniary loss caused or sought to be caused by the crimes alleged; or iii. The value of the convicted owner's interest in the property. WHEREFORE, the County requests that: A. This Complaint be joined in a single, bifurcated action with Defendant's criminal case, D-202-CR-2014-01545, as mandated by State v. Nunez, 2000 NMSC 13, 104, 129 N.M. 63, 2 P.3d, 264, and the Forfeiture Act, N.M. Stat. Ann. 1978 31-27-6(C); B. Following Defendant's conviction of said criminal offenses, that the Court then proceed with the determination of the forfeiture of Defendant's rights to and interests in the described cash monies raised in this Complaint; C. If the Court enters a Judgment terminating said rights and interests, as well as those of any other interested parties, that said monies be released to the Bernalillo County Sheriff's Department for disposition in accordance with the Controlled Substances and Forfeiture Acts, and for such other further relief this Court may deem just and proper.
