NOTICE OF BOND ELECTION of the EASTERN SANDOVAL COUNTY ARROYO FLOOD CONTROL AUTHORITY IN SANDOVAL COUNTY, NEW MEXICO To Be Held At The Same Time As And Consolidated With The General Election On TUESDAY, NOVEMBER 4, 2014 PUBLIC NOTICE IS HEREBY GIVEN that at a bond election to be held at the same time as and consolidated with the general election to be held on Tuesday, November 4, 2014, between the hours of 7:00 a.m. and 7:00 p.m. there will be submitted to the registered, qualified electors of the Eastern Sandoval County Arroyo Flood Control Authority, in the County of Sandoval and State of New Mexico (herein the "Authority," the "County" and the "State," respectively), the following question: FLOOD CONTROL BOND QUESTION SUBMITTED: "Shall the Eastern Sandoval County Arroyo Flood Control Authority, in the County of Sandoval and State of New Mexico, be authorized to issue in one series or more, the Authority's general obligation flood control bonds, in the aggregate principal amount not exceeding $2,200,000, for the purpose of defraying in part the cost of acquiring, improving, equipping, maintaining and operating projects or facilities of the Authority's multipurpose flood control system, including, without limiting the generality of the foregoing, channels, dams and appurtenances useful or convenient for the interception and transportation of flood waters to, in part, enhance water recharge, and protection of the environmentally sensitive lands, and all costs of the projects; the bonds being payable from general (ad valorem) tax proceeds and any other revenues of the Authority upon such terms and conditions, with such covenants and agreements, and with such other detail as the Authority's Board of Directors may determine?" The Authority consists of the part of the County located within the boundaries (as adjusted) delineated in Sections 72-20-1 through 72-20-103, NMSA 1978, as amended and supplemented (herein the "Act"), pursuant to which the Authority was created and organized and under which the Authority is operating. The term "elector" means a person who, on the day of election, is a citizen of the United States, at least 18 years of age and a resident of the Authority and of the precinct in which he or she offers to vote (except for the absent voter precincts). Each elector must be registered to vote in Sandoval County on the day of election as provided in the Election Code. For the purpose of determining the qualifications of any person desiring to vote as an elector of the Authority in any precinct located only partially within the Authority and judge of election may require the execution by such person of an affidavit to evidence such qualification. The polling places, voting precincts and judges of election for the bond election shall be the same as those within the Authority and designated by the County for the general election to be held at the same time, i.e., pursuant to the Proclamation of General Election, issued by the Office of the Sandoval County Clerk. Additional information may be obtained during regular office hours from the County Clerk at her office in the County Administrative Offices, 1500 Idalia Road, Building D, Bernalillo, New Mexico, concerning polling places, voting precincts and other details relating to the general election or at the Bernalillo Municipal Offices c/o Ida Fierro, 829 Camino Del Pueblo, Bernalillo, New Mexico, concerning the bond election of the Authority held at the same time as the general election and consolidated therewith. Voting machines to be used in the general election shall also be used for the bond election and the vote cast at such election for or against the bond question shall be on counters of the automatic voting machines locked off and separate from all other counters on the machines. Each elector of the Authority desiring to vote shall cast his or her ballot at the polling place for the election precinct in which he or she resides except for absent voter precinct polling place. Absentee voting shall be permitted as authorized by the Absent Voter Act of the Election Code, i.e., Sections 1-6-1 through 1-6-25, NMSA 1978. Applications for absentee ballots may be obtained from the Office of the County Clerk of Sandoval County, County Administrative Offices, 1500 Idalia Road, Building D, Bernalillo, New Mexico; but at 5:00 p.m. on Monday, November 3, 2014, the County Clerk is required to publicly destroy unused ballots. Completed applications must be returned to the County Clerk prior to that time. The County Clerk of Sandoval County, New Mexico is required by law to close the registration books for the election at 5:00 p.m., on Tuesday, October 7, 2014, and a person will be allowed to vote only if he or she is an elector of the Authority and currently registered to vote in the Authority at that time. Any qualified elector of the Authority who is not now registered and who wishes to vote at the election should register during regular office hours at the office of the County Clerk of Sandoval County, County Administrative Offices, 1500 Idalia Road, Building D, Bernalillo, New Mexico or with any registration agent at a designated agency as provided in Sections 1-4-47 and 1-4-48, NMSA 1978, prior to 5:00 p.m. on Tuesday, October 7, 2014. For federal qualified electors and overseas voters, the County Clerk shall accept a certificate of registration by electronic transmission from a voter qualified to apply for and vote by absentee ballot in the Authority if the transmission is received before 5:00 p.m. on October 31, 2014, the Friday immediately preceding the election.
